1. The matter has come up on application (01/2026) filed by the petitioner under Article 226 of the Constitution of India for extension of the period of interim bail granted to the petitioner on 18.08.2025, on the ground of right knee replacement surgery of his father.

Learned counsel for the petitioner submits that the petitioner was granted benefit of interim bail vide order dated 18.08.2025 passed in the instant Criminal Writ Petition, which was subsequently extended vide orders dated 16.10.2025 and 07.11.2025, on the ground of knee replacement surgery and post-

operative care of the petitioner’s father.

3. It is further submitted that although, left knee replacement surgery of the petitioner’s father was performed, his post- operative recovery remained unsatisfactory. In the meantime, the petitioner’s father started suffering from persistent radiating pain, severe discomfort and restricted mobility. Upon medical evaluation, MRI findings revealed lumbar spondylosis with multilevel disc bulges at L2-L3, L3-L4, L4-L5, and L5-S1, accompanied by nerve root compression resulting in lumbar radiculopathy, due to which the further knee replacement surgery could not be performed.

It is submitted that the petitioner’s father has now been advised hospitalization for the said surgery at Vasundhara Hospital Limited, Jodhpur, with the date of admission fixed as 16.02.2026 and the scheduled date of surgery as 17.02.2026. It is contended that the petitioner is the sole male member of the family and is required to take care of his ailing father and other family members. In support of the aforesaid contentions, learned counsel has placed reliance upon the medical records of the petitioner’s father. Therefore, it is prayed that the period of interim bail granted to the petitioner may be extended for a further period of

180 days.

5. On the last occasion i.e. on 29.01.2026, learned Public Prosecutor was directed to procure the medical report with regard to the ailment of petitioner’s father. Today, learned Public Prosecutor has produced the report received from SHO, Police Station Kotwali Sirohi, District Sirohi, wherein the aforesaid facts have been duly verified and the report of Vasundhara Hospital Limited, Sector 11, Chopasani Housing Board, Jodhpur stated that the date of admission has been fixed on 16.02.2026. The said report be taken on record.

6. Learned Public Prosecutor has opposed the prayer for extension of period of the interim bail, but is not in a position to dispute the fact that the petitioner’s father requires treatment.

In this background and for humanitarian grounds and there being no legal impediment to extend the temporary bail period, the application (01/2026) is allowed and the period of interim bail already granted by this Court, vide order ibid, is hereby extended for 90 days. The convict-petitioner Sameeir Modi S/o Shri Bharat Modi, shall be released on interim bail for further period of 90 days’ on the same conditions/directions and the bail and bonds furnished by him in terms of the order dated 18.08.2025 passed in the instant petition.

8. It is made clear that the instant order shall be applicable qua all the FIR’s, the recital of which has been given in the present petition.

9. Learned Public Prosecutor is directed to procure the status report/case diary/factual report with regard to the surrender of the petitioner before the Jail Authorities by the next date of hearing.
