1. The instant bail application has been filed under Section 483

BNSS on behalf of accused-petitioner. The accused-petitioner has

been arrested in connection with FIR No. 18/2025 registered at

Police Station Special Police Station (SOG), District ATS & SOG for

the offences under Sections 420, 120-B of IPC and Sections

2(f)(ii), 3, 4, 6 and 10 of Rajasthan Public Examination (Measures

to Prevent Unfair Means in Recruitment) Act, 2022.

2. Learned counsel for the accused-petitioner submits that the

accused-petitioner has falsely been implicated in this case. He

further submits that the petitioner was arrested on 10.06.2025

and charge-sheet has already been submitted. It is also contended

that two cases were registered against the petitioner and other

co-accused for leaking the paper of Pradhyapak School Shiksha,

2022. The accused-petitioner was in custody in another FIR

No.227/2022 registered at Police Station Bekariya and the present

case was lodged in Police Station SOG on 10.04.2025. It is also

contended that there is no substantive material available on

record indicating the petitioner's involvement in leaking the

papers. The main co-accused Kavita Lekhra was granted bail vide

order dated 01.12.2025 by Hon'ble Apex Court in SLP

No.17462/2025 and thereafter other co-accused Omprakash and

Deepak Lakshkar were also granted bail on the ground of parity

with the other co-accused Kavita Lekhra. The other co-accused

Sumer Bishnoi, Omprakash, Vaidhayi, Gopal, Roshan and Padma

have already been enlarged on bail by this Court by various

orders. The charge-sheet against the petitioner has already been

submitted and trial of the case may take considerable time,

therefore, the bail application of the accused-petitioner may be

allowed.

3. Learned Public Prosecutor has vehemently opposed the bail

application and contended that the petitioner is involved in mass

cheating and leaking of the papers of Pradhyapak School Shiksha,

2022, the accused-petitioner was also found to involve in other

cases of similar nature, therefore, looking to the fact that the act

of the petitioner is a menace to the society, therefore, the bail

application of the accused-petitioner may be dismissed.

4. Heard and perused the material available on record.

5. Considering the fact that the accused-petitioner is already in

custody in another case from 18.04.2022 till his bail granted in

another FIR, registered at Police Station Bekariya. In the instant

case, the charge-sheet has already been submitted and main co-

accused Kavita Lekhra has already been enlarged on bail by the

Hon'ble Apex Court and similarly this Court has also enlarged the

other co-accused Omprakash and Deepak on bail, on the ground

of parity with Kavita Lekhra, therefore, considering the above facts

and without commenting anything on the merits of the case, I

deem it just and proper to enlarge the accused-petitioner on bail.

6. Accordingly, the bail application under Section 483 BNSS is

allowed and it is ordered that the accused-petitioner Vijay Kumar

Damor S/o Shri Lalit Kumar Damor, in connection with FIR

No. 18/2025 registered at Police Station Special Police Station

(SOG), District ATS & SOG, shall be enlarged on b
