1. This anticipatory bail application has been filed under Section 482 of BNSS, 2023 on behalf of accused-petitioner in connection with FIR No.17/2017 registered at Police Station Mathura Gate, District Bharatpur for the offences under Sections 420, 406 and

120-B IPC.

2. Learned counsel for the petitioner submits that the accused- petitioners have been implicated in this case merely because they are the shareholders in the company against which, the complainant has made allegations of cheating. He further submits that initially after completion of investigation the Police has submitted charge-sheet against 6 accused persons keeping the investigation pending against certain others including the present accused-petitioners under Section 173(8) Cr.P.C. He further submits that the competent court took cognizance against 7 persons including one Smt. Shobha Rani Kushwah. Again the order of taking cognizance, Smt. Shobha Rani Kushwah has preferred a petition bearing S.B. Criminal Misc. Petition No.3302/2023 and the Co-ordinate Bench after taken into consideration the compromise arrived at in between the complainant and the accused-petitioner, set aside the order of cognizance.

3. It is also submitted by counsel for the petitioner that the trial against 6 other co-accused persons have also been concluded vide judgment dated 11.11.2024 passed by learned Additional Chief Judicial Magistrate No.2, Bharatpur and those 6 persons have already been acquitted.

4. Learned counsel further submits that one of the co-accused, namely, Amit Garg against whom investigation was kept pending under Section 137(8) Cr.P.C. brought before this Court by filing S.B. Criminal Misc. Petition No.5561/2025 for quashing of FIR. The Co-ordinate Bench of this Court vide its order date 03.09.2025 has issued notice and further ordered that no coercive steps be taken against the co-accused, Amit Garg.

5. Learned counsel further submits that the complainants have been paid full money which they have invested in the company. Learned counsel further submits that this Court vide order dated 07.01.2026 directed the petitioners to appear before the Investigating Officer on or before 15.01.2026 and in compliance of the said order, the petitioners have appeared before the Investigating Officer on 21.01.2026 and have joined the investigation. He also submits that since the accused-petitioners have already been interrogated, the full payment has already been made to the investor-complainant, therefore, the accused- petitioners are no more required for any kind of interrogation or recovery.

6. Learned Public Prosecutor vehemently opposed the bail application. He also verify the fact that the accused-petitioners have already appeared before the Investigating Officer in compliance of the Court's order.

7. Considered the submissions made by counsel for the petitioner as well as learned Public Prosecutor and also perused the material made available on record.

8. Taking into consideration the overall facts and circumstances as stated above, this Court without expressing any opinion on the merits or demerits of the case deems just and proper to extend the benefit of anticipatory bail to the accused-petitioners.

9. Accordingly, this anticipatory bail application under Section 482 B.
