1. By way of this criminal misc. petition under Section 528 of the B.N.S.S., the accused-petitioner has approached this Court with a prayer to quash criminal proceedings in Cr. Case No.104/2022 pending against him before the learned Civil Judge & Judicial Magistrate, Roopbas, District Bharatpur for offence under Section 498A of IPC, arising out of FIR No.374/2020 registered at Police Station Roopbas, District Bharatpur for the offences punishable under Sections 498-A, 406, 323, and 341 of IPC.

2. After registration of the aforesaid FIR, the police thoroughly conducted investigation in the matter and filed charge-sheet before the learned court below against the petitioner.

3. On 18.12.2025, both the parties filed an application to attest the compromise arrived at between them in the spirit of Lok Adalat for offences punishable under Sections 323, 341 & 406 IPC before the Trial Court. It is stated in the application that the parties have resolved their dispute amicably and entered into a compromise.

4. The Trial Court allowed the said application and attested the compromise arrived at between the parties for the offences punishable under Sections 406, 323 & 341 of IPC vide order dated

18.12.2025.

5. Now, the petitioner has approached this Court by way of this petition to quash the criminal proceedings pending against him before the Trial Court for offence under Section 498A of IPC on the basis of compromise arrived at between the parties.

6. Learned counsel for the complainant submits that the complainant has no objection if the criminal proceedings for offence under Section 498A IPC are quashed against the petitioner.

In view of the aforesaid and considering the submissions made on behalf of the respective parties; the material made available for my perusal; considering the fact that petitioner and complainant have arrived at compromise and settled their dispute and in the view of the law laid down by the Hon’ble Apex court in the case of B.S. Joshi Vs. State of Haryana, reported in 2003 (4) SCC p.675 in which it has been held that the proceedings under Section 498A IPC can be quashed because it is the matrimonial matter, and also finding that the present case is wholly covered by the principle of law laid down by Hon'ble the Supreme Court in the case of Gian Singh Vs. State of Punjab &

Anr-reported in 2012 Cr.L.J. (SC) 4934 and in the case of State of Haryana & Ors. Vs. Choudhary Bhajan Lal & Ors. [AIR 1992 SC 604], the criminal proceedings for offence under Section 498A IPC pending against the petitioner are liable to be quashed in view of compromise arrived at between the parties although the offence punishable under Section 498A of IPC alleged to be made out in the instant case is not compoundable.

8. In view of the above, this Criminal Misc. Petition is allowed and the criminal proceedings in Cr. Case No.104/2022 pending before the learned Civil Judge & Judicial Magistrate, Roopbas, District Bharatpur for offence under Section 498A of IPC against the petitioner, arising out of FIR No.374/2020 registered at Police Station Roopbas, District Bharatpur, are quashed and set aside.

Consequence to follow.
