1. The instant third bail application has been filed under Section 483 BNSS on behalf of the accused-petitioner. The accused- petitioner has been arrested in connection with FIR No. 218/2023, registered at Police Station Halena, District Bharatpur, for offences under Sections 147, 148, 149, 307, 302 and 120-B of the IPC.

2. Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated under Section 302 read with Section 120-B of IPC. He further submits that the first bail application of the accused-petitioner was dismissed vide order dated 09.10.2024, with the liberty to file afresh after recording of the statement of injured Vijaypal. It is also contended that there is no substantive evidence available on record that the petitioner hatched conspiracy with the other co-accused namely: Vishnu, Saurabh, Pankaj, Lokendra, Robin, Rahul and Devendra to cause the murder of deceased Kuldeep and to inflict life-threatening injuries upon injured Vijaypal. It is further contended that the petitioner is a police constable and has been in custody for a long period. The material eye witnesses have turned hostile and have not corroborated the prosecution's story; therefore, the third bail application of the accused-petitioner may be allowed.

Learned Public Prosecutor and learned counsel for the complainant have vehemently opposed the third bail application and contended that the bail application of similarly placed co- accused Aaditya was dismissed on 06.05.2025. It is submitted that the petitioner Ravindra is the real brother of Kripal Singh, whom Kuldeep Singh and his associates murdered. To take revenge for the murder of Kripal Singh, the petitioner, after hatching a conspiracy with the main assailants, namely: Lokendra Singh, Pankaj, Saurabh, Robin, Rahul, Devendra and Vishnu, murdered Kuldeep and caused injuries to Vijaypal. It is also contended that the accused Ravindra was in continuous touch with the main accused Lokendra, Rahul @ Bhula, Dharmraj, Pankaj, and other co-accused, who have also been alleged as offenders under Section 120-B of IPC. It is vehemently argued that the call detail analysis collected by the Investigating Officer clearly shows that the petitioner, Ravindra, called the other co-accused, Lokendra Singh, between 01.01.2023 and 15.07.2023, making 87 calls and receiving 53 calls. The messages were also conveyed; similarly, Ravindra was in continuous touch with the other co- accused, Pankaj, and made 691 calls, of which 427 were outgoing and 223 were incoming calls. The call details also shows that the petitioner was in continuous touch with the other co-accused and made several calls; therefore, considering the above facts, the third bail application of the accused-petitioner may be dismissed.

It is alleged against the petitioner that to take revenge for his brother's murder, the petitioner hatched a conspiracy with the main accused, Lokendra and Pankaj, and remained in continuous contact with them before and after the incident.
