1. This criminal miscellaneous bail application has been filed by the petitioner under Section 483 of BNSS, 2023 in respect of FIR No.101/2025 registered at Police Station Baseri, District Dholpur for the offences punishable under Section 189(2), 115(2), 126(2), 301 and 352 of BNS.

2. It is submitted by learned counsel for the petitioner that on account of spur of moment, sudden fight took place between the petitioner's side and the complainant's side. Therefore, cross FIRs were filed. Both the sides have sustained injuries in the said incident and in respect of cross FIR No.100/2025, the complainant in the said FIR has been enlarged on bail by the learned trial Court vide order dated 06.10.2025. It is further submitted that after completion of investigation, charge-

sheet has been filed in the instant matter, therefore, he is no longer required for any custodial interrogation. It is submitted that the petitioner is behind the bars since 20.09.2025 and in the instant case trial is likely to take considerably long time. Hence, a prayer has been made to enlarge the petitioner on bail.

3. Learned Public Prosecutor has vehemently opposed this bail application.

4. Considered the submissions made at Bar.

In the light of the facts that as per record, there were cross cases in relation to same incidents and in respect of FIR No.100/2025 lodged by the petitioner, the other side (complainant side) have been enlarged on bail and even in respect of present FIR No.101/2025, after completion of investigation, charge-sheet has been filed and trial is likely to take considerably long time. Hence, this Court without expressing any opinion on the merits and demerits of the case, deems it just and proper to enlarge the petitioner on bail.

6. Accordingly, this Bail Application is hereby allowed. The accused-petitioner Bablu S/o Ramveer shall be released on bail in pursuance of FIR No. 101/2025 registered at Police Station Baseri, District Dholpur on furnishing a personal bond of Rs. 1,00,000/- along with two sureties of Rs.50,000/- each. That apart, the accused-petitioner shall also follow the conditions as under:-

(i) He shall not tamper with any evidence, nor would influence the witnesses in the case.

(ii) He shall not leave the country without prior permission of the Court.

(iii) He shall co-operate in the trial and shall attend each and every date of hearing in the trial, until and unless his presence is exempted by the trial Court.
