1. Instant writ petition is preferred by petitioner with following prayer:
“i) Issue an appropriate writ order or direction in the nature thereof thereby, directions be issued to the respondents to give appointment to the petitioner on the post of Teacher Grade III Level II Science Math under Outstanding Sports Person Category.
ii) Issue an appropriate writ order or direction in the nature thereof thereby, the respondent be directed to consider the sport certificate of petitioner as valid for appointment to the post of Teacher Gr. III Level 2 Science Math.
iii) Issue an appropriate writ order or direction in the nature thereof thereby, the action of the respondents may kindly be declared illegal by which they are not considering the sports certificate of petitioner as valid.
iv) Issue an appropriate writ order or direction in the nature thereof thereby, the respondents may kindly be directed to give same benefit as given in the case of Garvit Vyas Vs. State of Rajasthan (D.B. Special Appeal Writ No. 111/2025) decided on 01.08.2025.”
2. Mr. Gopal Krishan Sharma, AGC accepts notice on behalf of respondent Nos. 1 and 2 and Mr. Nalin G. Narain accepts notice for respondent No.3.
3. Office is directed to reflect name of Mr. Gopal Krishan Sharma, AGC and Mr. Nalin G. Narain as counsel for respondent.
4. Learned counsel for petitioner submits that the controversy raised herein is already settled by judgment of Division Bench at Principal Seat, Jodhpur in DB Special Appeal Writ No. 111/2025 titled as Garvit Vyas Vs. State of Rajasthan and Ors. decided on 01.08.2025 and considered by this Court as well in SB CWP No. 12634/2025 titled as Jitendra Vs. State of Rajasthan and Ors. On 07.10.2025, therefore the writ petition be disposed of in light of judgment in case of Garvit Vyas Vs.
State of Rajasthan and Ors. (supra).
5. Learned counsel for respondent submits that subject to verification of veracity of facts as claimed by the petitioner, the writ petition be disposed of.
6. Having considered aforesaid, the writ petition is disposed of in light of case of Garvit Vyas Vs. State of Rajasthan and Ors. (supra) and respondents are directed to conduct an inquiry in relation to the certificates as submitted by petitioner as early as possible preferably within a period of 8 weeks from date of receipt of copy of this order. If petitioner is found to be an outstanding sports person then only candidature of petitioner be strictly considered in accordance with merits for the category for which the petitioner for filed an application.
7. In case of deviation, the respondents are under an obligation to decide the issue with a reasoned and speaking order within a period of 30 days after concluding the inquiry.
8. With aforesaid, the writ petition along with misc. application, if any, stands disposed of.
