1. Learned counsel for the petitioner submits that an application for allotment of a land of Khasra No.1047 ad- measuring 1.5300 hectares situated in village Bansara, Tehsil Gogunda, District Udaipur was filed in year 2018 for allotment under the Rajasthan Land Revenue (Allotment of Unoccupied Government Agricultural Lands for the Construction of Schools, Colleges, Dispensaries, Dharamshalas and Other Building of Public Utility) Rules, 1963.
2. Learned counsel for the petitioner submits that after completing due enquiry and being satisfied by the required formalities being completed by the petitioner-trust, the District Collector, Udaipur vide its communication dated 16.05.2022 has forwarded the proposal for the said allotment to be made in favour of the petitioner along with the report of Sub Divisional Officer, Gogunda as well as Tehsildar, Gogunda to the respondent No.1.
3. Learned counsel for the petitioner submits that thereafter no effective action has been taken upon the petitioner’s application and for the said purpose repeated representations/reminders were being sent.
4. Learned counsel for the petitioner seeks limited indulgence of this Court for directing the respondent- Authorities to decide its pending application for allotment of land for the purpose of expansion of the educational institute.
5. In view of the submissions made, this Court deems it appropriate to dispose of the present writ petition while directing respondent No.1-State to decide the pending application/proposal forwarded by the District Collector vide its communication dated 16.05.2022 expeditiously in accordance with law preferably, within a period of two months from the date of passing of this order.
6. It is made clear that this order shall not be construed as direction to the respondent- Authority to decide the representation of petitioner in any manner, but only in accordance with law.
7. With these observations, the present writ petition stands
