1. The parties are also present before this Court along with their respective counsels. Instant contempt petition has been filed under Section 12 of the Contempt of Court Act, 1971 for alleged non-compliance of the order dated 07.10.2023 passed by a co-

ordinate Bench of this Court whereby visitation rights were granted to the petitioner no.1/father. It was directed that the children shall be made available by the respondent (mother) for visitation at Kids Zone, near Hotel Novotel, Jodhpur, on every Sunday from 12:00 noon to 04:00 p.m.

Learned counsel for the petitioners submits that, despite having full knowledge of the order dated 07.10.2023, the non- petitioner/contemnor has willfully and deliberately failed to comply with the same. Since the passing of the said order, the non- petitioner has neither brought the children to the designated place nor permitted the petitioners to meet them. This is notwithstanding repeated efforts made by the petitioners through telephone calls and WhatsApp messages on several Sundays during the years 2023–2024.

2.1. It is further submitted that such continued non-compliance has caused serious prejudice to the welfare and development of the children.

3. Per contra learned counsel for the respondent denies any deliberate non-compliance on the part of the respondent in respect of any of the orders passed by this court.

4. Having heard the respondent/mother as well as petitioner No.1/father, we are of the view that both parties are broadly ad idem with the visitation arrangement directed by this Court vide order dated 07.10.2023.

5. The respondent/mother, however, submits that occasional deviations from the said arrangement have occurred solely on account of the children’s prior engagement in extra-curricular activities. In this regard, it is stated that on the last Sunday, i.e.

08.02.2026, the respondent had duly brought the minor daughter to the designated place for visitation, whereas the minor son could not be made available simultaneously as he was required to participate in a Karate tournament scheduled for the same day.

Be that as it may, and without delving further into the controversy relating to alleged non-compliance, both parties are though agreeable to the duration and frequency of visitation, but it is mode and manner of visitation which is causing certain misunderstanding and acrimony between them. With a view to facilitating effective implementation of the order and, more importantly, to secure the welfare and comfort of the children, we deem it appropriate to suitably modify the venue of visitation.

7. Accordingly, with the mutual consent of the parties present in the court, in partial modification of the earlier direction requiring the children to be brought to Kidz Zone near Hotel Novotel, Jodhpur, we direct that the children shall meet petitioner No.1– father at his residence, where the grandparents are also residing,
