2. In the interest of justice, the application is allowed.
3. The reschedule date of marriage i.e 14.02.2026 mentioned in the interim bail application (S.B. Criminal Misc. Bail (Interim) Application No.1054/2026) is replaced with the earlier date of marriage i.e. 24.01.2026.
S.B. Criminal Misc. (Interim) Bail Application No. 1054/2026
1. The petitioner has filed this bail application under Section 483 of BNSS in FIR No.427/2025 registered at Police Station Kotwali, District Nimbahera for offence under Sections 8/15 of the NDPS Act.
2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record.
3. Learned counsel for the applicant submits that the applicant is in judicial custody in connection with the aforesaid case. It is contended that the marriage of the petitioner's sister is going to be solemnized on 14.02.2026 and as per the petitioner, he is the only son in the family, therefore, looking to the rituals of marriage ceremony he may be granted interim bail. Relevant verification report dated 07.02.2026 has also been placed on record. It is further submitted that the applicant undertakes to surrender immediately after expiry of the interim bail period and shall not misuse the liberty so granted.
4. Per contra, learned Public Prosecutor opposes the prayer; however, he does not dispute the marriage of the applicant’s sister.
5. Having considered the submissions made by the learned counsel for the parties and after perusing the material available on record, particularly, upon perusal of the verification report received from the concerned SHO, the marriage of the petitioner's sister is going to be solemnized on 14.02.2026 and also the fact that as per certificate issued by concerned Gram Panchayat, he is the only son in the family, therefore, looking to the rituals of marriage ceremony, this Court is of the view that the presence of the applicant is required for above purpose. Hence, without expressing any opinion on the merits of the case, this Court deems it appropriate to grant interim bail to the applicant for a limited period of four days.
6. The applicant Lovepreet Singh S/o Jagtaar Singh is directed to be released on interim bail for a period of 04 days from 13.02.2026 i.e. the date of his release to 16.02.2026, in connection with aforesaid FIR on his furnishing a personal bond in the sum of Rs.50,000/- with one surety of the like amount to the satisfaction of the Trial Court/Jail Authority, subject to the condition that the applicant shall surrender before the concerned jail authorities immediately upon expiry of the interim bail period of 04 days, unless the period is extended by a competent court.
7. It is made clear that if the applicant fails to surrender after the expiry of the interim bail period, the authorities shall be at liberty to proceed against him in accordance with law.
8. The interim bail application stands disposed of accordingly.
