1. By way of filing the instant writ petition under Article 226 of the Constitution of India, the petitioners have prayed for the following relief:
“(a)- by an appropriate writ, order or direction, this petition may kindly be allowed with costs and the action of the respondents in not making the payment of compensation in lieu of insurance premium deducted by the bank in regard to failure of the Kharif crops 2023-24 may kindly be set aside and the respondents may kindly be directed to pay the claim amount of insurance of Kharif crops year 2023-24 due to failure of crops with the interest @ 12% per annum.
(b)- That any order passed by the respondents denying claim of kharif insurance-2023-24 to the petitioners may be quashed and set-aside.”
2. After hearing the learned for the petitioner, this Court deems it just and proper to dispose of the present writ petition with a direction to the petitioner to submit a detailed representation before the respondents Nos.1 and 2 within a period of 15 days, for ventilating his grievances. Upon receipt of such representation, the respondents Nos.1 and 2 shall consider the same in conformity with the Office Memorandum dated 09.09.2020 issued by the Ministry of Agriculture and Farmers Welfare, Department of Agriculture, Cooperation and Farmers Welfare under subject “Constitution of Committee for settlement of additional claims arising due to problems/mistakes/errors/ omissions under Pradhan Mantri Fasal Bima Yojana (PMFBY) and Restructure Weather Based (RWBCIS), within a period of eight weeks thereafter.
3. It is made clear that the direction to decide the above representation has been issued only with a view to ensure expeditious redressal of grievances of the petitioner and the same may not be construed to be an order to decide the petitioner’s representation in a particular manner.
4. The writ petition is disposed of in the above terms.
5. Stay application also stands disposed of.
