1. This writ petition has been filed by the petitioner with following prayer:

"It is therefore, most humbly prayed that your Lordships may graciously be pleased to accept and allow this writ petition and called for the relevant record and may kindly be examined, and:-

a. By appropriate writ, order and direction the action of the respondent/medical Board, whereby, petitioner was orally informed that disability of petitioner is only 35% instead of 42%, which declared petitioner disqualified to be considered in the category special abled by held illegal;

b. By appropriate writ, order and direction directed to the respondent to re-conduct the medical of petitioner through the independent medical board under the guideline dated 12.03.2024.

c. By appropriate writ, order and direction directed to the respondents, after re-medical, if petitioner found eligible then he may be given appointment on the post of Teacher Grade-III Level-I in Zila Parishad, Jaipur with all consequential benefits.

d. Any other appropriate order or direction may also be passed in favour of the humble petitioner."

2. Vide order dated 06.11.2025, the Coordinate Bench of this Court directed the petitioner to appear before the Medical Board to be constituted by the AIIMS, Jodhpur for medical examination in order to assess impairment/physical disability of the petitioner.

3. After examination, the Board was directed to send copy of report to this Court also.

4. This Court has received one report dated 08.01.2026 sent by the Medical Board of AIIMS Jodhpur wherein, it has been mentioned that the Board has examined the nature and extent of physical disability of the petitioner and after examination, report has been given that the petitioner is suffering from Locomotor Disability @ 42%.

5. Under the Rules, a person who is suffering from physical disability of more than 40%, is to be considered for the 6. Thus, treating the petitioner to be eligible for the Person, respondents are directed to proceed further and in case, the petitioner is otherwise found eligible and suitable, appointment order be issued by the respondents in favour of petitioner. In that case, the petitioner shall also be entitled for all the benefits on notional basis from the date on which, other similarly situated persons have been given appointment on the post of Teacher Grade-III Level-I.

7. The writ petition stands disposed of, accordingly.
