1. Instant writ petition is allowed by a Co-ordinate Bench of this Court on 12.10.2017 with following order:
“The Writ Petition No.5254/2014 is allowed and order dt. 5th March, 2014 is quashed and set aside. Writ Petition No.11716/2016 is allowed and impugned order dt. 17th September, 2014 is quashed and set aside with the direction to the respondent to take back the petitioner on duty on the post of Store-Munshi and to confer all the benefits as has been ordered by the learned Labour Court within a period of two months.”
2. While considering the writ petition, only for compliance of order, the matter was kept alive. During process to ensure compliance, this court has passed certain order on 28.01.2026 and thereafter the respondents have issued an order to make payment of ₹43,61,139/- to the petitioner, vide order dated 05.02.2026. Learned counsel for petitioner has acknowledged the receipt of aforementioned amount.
3. Now, the dispute pertains to house rent allowance (HRA) and order dated 05.02.2026 specifically point out about mode of computation of HRA after enquiry by a Senior Officer of accounts service. The conditions as mentioned in order dated
05.02.2026 are reproduced as under:

Learned AAG has submitted that petitioner has filed an application for sanction of HRA on 03.05.2019 to grant HRA from May, 2018 and same was considered by the respondents in accordance with House Rent allowance Rules notified on 03.10.1989 by Finance Department. She further submits that issue of HRA shall be examined by the department in accordance with rules.
5. Having considered submissions of learned counsel for petitioner and learned AAG, the respondents are directed to examine the claim of HRA made by the petitioner prior to May, 2018 within a period of 60 days from date of receipt of copy of this order.
