1. The matter comes upon an application filed on behalf of petitioner Umrao Mal for grant of interim bail to attend the marriage of his niece.

2. Learned counsel for the petitioner submits that the marriage of petitioner’s real niece is going to be solemnized on 13.02.2026. In support of his contentions, wedding card has also been annexed to this interim bail application. Learned counsel further submits that the petitioner is ready and willing to furnish bail bonds for his interim release, hence, the accused-petitioner may be granted the benefit of interim bail for a period of thirty days.

3. Learned Public Prosecutor opposes the interim bail application. However, he submits a report dated 11.02.2026 given by SHO of the concerned police station confirming the fact of marriage of petitioner’s niece on 13.02.2026.

4. Heard learned counsel for the parties and perused the material available on record.

5. Looking to the totality of facts and circumstances of the case and after going through all the documents related to the marriage of the petitioner’s niece, a humanitarian approach is required to be adopted so as to enable petitioner to attend the marriage of his niece, thus, this Court deems it just and proper to grant interim bail to the accused-petitioner for two days i.e. 12.02.2026 and

13.02.2026.

Accordingly, this interim bail application is allowed and it is ordered that the accused-petitioner- Umrao Mal S/o Dulharam, shall be enlarged on interim bail for two days i.e. 12.02.2026 and 13.02.2026, provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each, out of which one surety shall be a closed relative of accused-petitioner, to the satisfaction of the Superintendent, Sevar Jail, Bharatpur with the condition that he shall maintain peace and good behavior during the period of interim bail and shall not commit any offence.

7. The accused-petitioner shall surrender himself before the Superintendent of the concerned Jail Authority, on 14.02.2026 by

5:00 PM.

8. If the petitioner fails to surrender before the concerned Jail Authority as directed above, the Jail Authority shall be free to take action against him in accordance with law.

9. Learned Public Prosecutor is directed to submit a report of concerned Superintendent of Jail Authority, regarding surrender of the petitioner, before this Court.

10. Let a copy of this order be supplied to the concerned Jail Authorities.

11. List this bail application on 16.02.2026.
