1. The matter comes up on an application filed under Article 226 of the Constitution of India read with Section 528 of BNSS (IA No.01/2025) on behalf of the petitioner seeking extension of the interim/temporary bail granted by this Court vide order dated 27.11.2025, passed in S.B. Criminal Misc. Bail Application No.13580/2025 on the ground of treatment of petitioner’s wife.

2. Heard learned counsel for the petitioner and the learned Public Prosecutor.

3. Learned counsel for the petitioner submits that the wife of the petitioner is suffering from Uterine Fibroids. As per medical report, she requires to undergo Laproscopic Myomectomy, which was scheduled on 30.11.2025 and for that purpose interim bail for a period of 30 days was granted by this Court vide order dated 27.11.2025 but due to lack of blood, operation of Laproscopic Myomectomy was not scheduled and the Doctor had stated to review the same after 10 days and thereafter operation will carried out. He relied upon the prescription slip issued by Dr. Vishwdeep Singh Rathore, Professor and Unit Head (Medicine Department), MDM, Jodhpur. Therefore, he prayed for extension of temporary bail for a period of 30 days for the said purpose.

Learned Public Prosecutor has opposed the prayer for extension of temporary/interim bail; however, she is not in a position to dispute the fact the date of surgery of petitioner’s wife has been postponed. She submitted the report dated 17.12.2025, sent the SHO, P.S. Baap, District Phalodi along with the medical documents. The same is taken on record.

After considering the overall facts and circumstances of the case and upon careful perusal of the material available on record, more specifically the as per prescription slip issued by Dr. Vishwdeep Singh Rathore, Professor and Unit Head (Medicine Department), MDM, Jodhpur, the O.T. was cancelled due to lack of blood and the date of surgery has been postponed, this Court deems it appropriate to extend the interim bail/temporary bail of the petitioner for a further period of 30 days.

In this background and for humanitarian grounds and there being no legal impediment to extend the period of interim bail/temporary, the instant application is allowed and the period of interim bail already granted to the petitioner Rakesh S/o Mohan Ram, by this Court, vide order ibid, is hereby extended for further 30 days on the same conditions/directions and the bail bonds furnished by him in terms of the order dated 27.11.2025, passed in S.B. Criminal Misc. Bail Application No.13580/2025.

7. Learned Public Prosecutor is directed to procure the status report/factual report with regard to the surrender of the petitioner before the Jail Authorities by the next date of hearing.

8. List the matter on 22.01.2026.
