1. The application (IA No.02/2025) has been filed by the petitioner seeking further extension of the interim bail granted vide order dated 28.08.2025 passed by this Court, on the ground that father of the petitioner has recently undergone (Transurethral Resection of the Prostate) TURP Surgery and has developed Urinary Tract Infection and therefore requires post-surgical monitoring care and regular check-up.
2. Heard learned counsel for the petitioner as well as learned Public Prosecutor.

Learned counsel for the petitioner submits that earlier the petitioner was granted interim bail for a period of 60 days vide order dated 28.08.2025 on the ground that petitioner’s father was advised (Transurethral Resection of the Prostate) TURP Surgery. However, due to certain complications and health issues, the surgery was post-poned and the doctor advised the operation of petitioner’s father on a later date. Thereafter, the bail granted to the petitioner was extended for a further period of 60 days vide order dated 30.10.2025 since the surgery was scheduled on 10.11.2025. It is submitted that now, the surgery of petitioner’s father has taken place on 08.12.2025. Additionally, the petitioner is required to take due care of his father since he is the only person and the sole caretaker available to provide due care and assistance to his father, who has recently undergone surgery and developed Urinary Tract Infection.
3. Vide order dated 15.12.2025 passed by this Court, the learned Public Prosecutor was directed to procure the medical report of the petitioner’s father. Today, the learned Public Prosecutor has produced the report dated 16.12.2025 sent by the SHO, Police Station Kotwali Sirohi, wherein the above stated facts have been verified. The said report is taken on record.
4. Learned Public Prosecutor has opposed the prayer for grant of temporary/interim bail; however, he is not in a position to dispute the fact that the petitioner is required to take post operative care of his father.
5. After considering the overall facts and circumstances of the case and upon careful perusal of the material available on record and considering the medical report of the petitioner’s father, this Court deems it appropriate to extend the interim bail/temporary bail of the petitioner for a further period of 20 days.
6. In this background and for humanitarian grounds and there being no legal impediment to extend the period of interim bail/temporary, the instant application is allowed and the period of interim bail already granted to the convict-petitioner Vivek Purohit S/o Shri Prakash Chandra Purohit, by this Court, vide order ibid, is hereby extended for another period of 20 days on the same conditions/directions and the bail and bonds furnished by him/her in terms of the order dated 28.08.2025 passed in S.B.
Criminal Writ Petition No. 2442/2025.
7. Learned Public Prosecutor is directed to procure the status report/case diary/factual report with regard to the surrender of the petitioner before the Jail Authorities by the next date of hearing.
8. List the matter on 19.01.2026.
