1. Since both these writ petitions filed by the petitioner relate to the recruitment process for the post of Lab Assistant initiated vide Advertisement dated 29.05.2018, they are being decided by this common order.

2. The facts in brief are that initially an advertisement for the post of ‘Lab Assistant’ was issued on 10.07.2013 and the petitioner being eligible, applied for the same. However, the experience certificate as submitted by the petitioner being not in the requisite format, the same was not considered. A writ petition (S.B. CWP No. 13506/2015) at that instance was filed by the petitioner wherein vide order dated 10.10.2017, the respondents were directed to issue an experience certificate to the petitioner in the requisite format for the period from 01.04.2011 to 31.03.2012. The experience certificate as directed by the Court was issued in favour of the petitioner, but then the petitioner remained unsuccessful in the said recruitment process.

3. Then again a recruitment process for the post of ‘Lab Assistant’ was initiated in year 2018 vide advertisement dated 29.05.2018. However, in the said recruitment process the format of experience certificate was changed. Meanwhile, the petitioner gained further experience and qua the said period i.e. from

01.07.2013 to 31.07.2016 (three years and one month), he was issued an experience certificate in the prescribed format.

4. In pursuance to the advertisement of 2018, the petitioner again applied and submitted both experience certificates alongwith the application form. However, although the subsequent experience certificate was considered, the earlier experience certificate for the period of 01.04.2011 to 31.03.2012 was not considered for the sole reason of it not being in the requisite format.

5. Again a writ petition (S.B. CWP No. 13137/2018) was filed by the petitioner and vide interim order dated 29.08.2018, the respondents were directed to issue a provisional experience certificate to the petitioner for the said period and further to permit him to participate in further selection process.

6. In compliance of interim order dated 29.08.2018, the experience certificate was issued in favour of the petitioner on 13.09.2018, which was counter signed by the competent authority on 01.11.2018. Interestingly, the said certificate was also not considered as it was issued on 13.09.2018 whereas the last date for submission of the application form was 30.06.2018.

7. Left with no other option, again a writ petition (S.B. CWP No. 201
