1. Heard learned counsel for the petitioner, learned AGA and interacted with Mr. Shaitan Singh Choudhary, Sub-Inspector, Police Station Shastrinagar, who is conducting the investigation in the matter and also gone through the case diary.
2. It is indeed an unpleasanct and sorrowful incident in which a young brilliant boy ended his life by committing suicide in the hostel complex of the medical college. After completion of MBBS degree, he was pursuing PG course there. Some circumstances are reported by the complainant casting serious doubts in the manner of death of the boy. There are allegations of instigation and of creating such an atmosphere in which he had gone into a state where he was left with no other way but to end his life.
3. The matter had been investigated by the police once and whereafter an opinion was formed that the allegations of abetment were not proved and it was a simple case of suicide under despersion. However, the said report was not submitted before the Judicial Magistrate, but was placed for approval before the superior police officials. The DCP, Jodhpur (West) vide letter No.22110 dated 28.12.2025 referred the matter back to the investigating officer after making four points of determination, which read as under :-

2. कॉलेज में मृतक द्वा(cid:6)ा प्रिप्रंप्रिसपल या अन्य प्रिकसी अप्रि#का(cid:6)ी को कभी प्रिलखि&त में
प्रि’कायत दी हो तो पत्रावली दे&ें।
3. उसके कोस(cid:10) का ’ैक्षप्रिणक रि(cid:6)कॉर्ड(cid:10) दे&ें औ(cid:6) ज्ञात क(cid:6)ें प्रिक उसकी थ्यो(cid:6)ी औ(cid:6)
प्रैखि3कल में प्रिकतने अंक आये थे औ(cid:6) प्रिकसी प्रका(cid:6) का उत्पीड़न तो नहींहुआ।
4. जयपु(cid:6) क्यो ं भेजा, एम्स क्यो ं नही।ं इसका का(cid:6)ण स्पष्ट क(cid:6)ें।
As on date, further investigation is underway, particularly on the aforementioned four points suggested by the DCP, Jodhpur (West).

The principal grievance of the petitioner is that since much time has elapsed and there are chances of distortion, vanishing and polluting evidence and there may be an occasion of retrieving some of the documents and therefore, it would be more apt if the investigation is directed to be undertaken by a superior official or be carried out under his monitoring and vigilence.

In view of the foregoing discussion, and upon due consideration of the rival submissions advanced by the learned counsel for the parties, coupled with a careful perusal of the case diary, this Court is of the considered and deliberate opinion that, in order to uphold the institutional sanctity of the investigating agency and to obviate any apprehension of arbitrariness or bias, Shri Shaitan Singh Choudhary, the incumbent Investigating Officer, shall continue to conduct the investigation in the matter. However, to further fortify the fairness, transparency, and impartiality of the investigative process, the said investigation shall remain under the close, continuous, and effective supervisory control of the Assistant Commissioner of Police of the concerned area, who shall maintain constant vigil over the case diary as well as the overall progress of the investigation, and shall be empowered to issue such appropriate, lawful, and necessary directions to the Investigating Officer from time to time as may be warranted, so as to ensure scrup
