Judgment

1. Being aggrieved and dissatisfied with the impugned termination order dated 26.09.2024 passed by the respondent No.3, whereby services of the petitioner on the post of Dairy Supervisor – III at Dugdh Utpadak Sahkari Sangh, Ajmer were terminated on account of submission of fake and forged experience certificates at the time of appointment, the petitioner has filed the present writ petition invoking Article 226 of the Constitution of India.

FACTUAL MATRIX OF THE LIS AT HAND:

2. The facts leading to the filing of the present petition, in a nutshell, are as under:

2.1 The respondent No.2 issued an advertisement inter alia inviting applications for recruitment to various posts in Rajasthan Cooperative Dairy Federation Limited (RCDFL), Jaipur and its affiliated Zila Dugdh Utpadak Sahkari Sangh.

2.2 A perusal of the said advertisement reveals that the minimum educational qualifications prescribed for the post of Dairy Supervisor – III was Senior Secondary, along with a mandatory work experience of three (03) years on the post of Secretary of a Dairy Cooperative Society.

2.3 The petitioner, in pursuance of the said advertisement, claiming to possess the requisite eligibility, applied for the said post at Dugdh Utpadak Sahkari Sangh, Ajmer, and submitted his Senior Secondary Examination marksheet and two experience certificates, both dated 01.12.2021, along with the application.

2.4 Consequent to the written examination held on

16.08.2021 and the process of document verification conducted on 09.12.2021 and 10.12.2021 qua the petitioner, an Offer of Appointment dated 08.03.2022 was issued. Subsequently, the appointment order dated 16.03.2022 came to be issued, and the petitioner joined his duties on the said post on 01.04.2022 on a probationary basis for a period of two years. Later, services of the petitioner were confirmed/made permanent vide order dated

22.04.2024 by the respondent No.3-employer.

2.5 The genesis of the dispute inter se the parties arose upon the receipt of a complaint/information by the Managing Director, Dugdh Utpadan Sahakari Sangh Limited, Sikar and Jhunjunu (hereinafter referred to as “Dairy Co-operative Society, Sikar and Jhunjunu), alleging that the petitioner had secured appointment to the said post by submitting false and fabricated experience certificates. Acting upon the said information, the respondent No.1-recruitment board issued a letter dated 26.04.2024 inter alia directing an inquiry and verification of the experience certificates submitted by all the candidates for the said post. Consequently, letters dated 02.05.2024 and 16.05.2024 were issued by respondent No. 2-RCDFL directing respondent No.3-employer to conduct a thorough verification of the experience certificates submitted by all the selected candidates and to take appropriate/necessary actions against the petitioner at the employer level.

2.6 In compliance with the instructions from RCDFL, respondent No.3 issued a letter dated 21.05.2024 to the petitioner, seeking an explanation qua the alleged forged and fabricated exper
