1. The instant bail applications have been filed under Section 483 of B.N.S.S. on behalf of accused-petitioners. The accused- petitioners have been arrested in connection with FIR No.357/2025, registered at Police Station Christianganj, District Ajmer, for the offence(s) under Sections 309(4) of BNS.

2. Learned counsel for the petitioners submits that the accused- petitioners have falsely been implicated in the present case. It is contended that the main allegation of committing robbery with the complainant is against the other co-accused. The only allegation levelled against the accused-petitioners is that they conducted recce and supplied information to the other co-accused. However, there is no substantive evidence available on record to establish the fact that the accused-petitioners conducted recce prior to the commission of robbery. The accused-petitioners are in custody since 11.12.2025, there are no criminal antecedents against them and the trial of the case may take considerable time, therefore, the bail application of the accused-petitioners may be allowed.

Learned Public Prosecutor has vehemently opposed the grant of bail and contended that the accused-petitioners conducted recce and provided information to the main co-accused, who committed the robbery with the complainant. Therefore, considering the aforesaid allegations, the bail application filed on behalf of the accused-petitioners may be dismissed.

4. Heard and perused the material available on the record.

5. The main allegations of committing robbery are against the other co-accused namely; Surendra, Suraj, Dilkhush and Deshraj and not against the present petitioners. The recovery of money was also affected from the other co-accused, therefore, considering the aforesaid facts and without commenting anything on the merits of the case, this Court deems it just and proper to enlarge the accused-petitioners on bail.

6. Accordingly, these bail applications under Section 483 of B.N.S.S. are allowed and it is ordered that the accused-petitioners namely; 1. Khushiram Choudhary S/o Shri Nathu and 2. Rajesh Jat S/o Laxman, R/o Kheda, in connection with FIR No.357/2025, registered at Police Station Christianganj, District Ajmer, shall be enlarged on bail provided both of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
