1. Petitioner has filed this bail application under Section 483 B.N.S.S., arising out of F.I.R. No.45/2025 registered with the Police Station Special Police Station- SOG, District ATS & SOG for offence under Sections 318(4), 338, 336(3), 340(2) & 61(2) of B.N.S., 2023 and Sections 3 & 21 of Banning of Unregulated Deposited Scheme Act, 2019.

2. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He further submits that the petitioner was only an employee in Harvest AI Technology Pvt. Ltd. Company and was acting under the instruction of the Director of the Company. He further submits that the Director of the said Company, who is also an accused, has already been enlarged on bail by the Co-ordinate Bench of this Court vide order dated 18.12.2025, in S.B. Criminal Misc. Bail Application No.14489/2025. He further submits that the accused- petitioner is in custody since 20.09.2025 and trial of the case will take time to conclude, therefore, he may be enlarged on bail.

3. Learned Public Prosecutor has vehemently opposed the bail application.

4. Considered the submissions made by counsel for the petitioner as well as learned Public Prosecutor.

5. Having considered the allegation against the petitioner and after going through the case diary as regard the evidence collected against him and more particularly the fact that co- accused under whom the petitioner was working, has already been enlarged on bail by the Co-ordinate Bench of this case and the accused-petitioner is in custody since 20.09.2025, this Court without expressing any opinion on the merits and demerits of the case, deems just and proper to enlarge the petitioner on bail.

This bail application is, accordingly, allowed and it is directed that accused-petitioner shall be released on bail provided he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the trial Court with the stipulation that he shall appear before that Court and any Court to which the matter be transferred, on all subsequent dates of hearing and as and when called upon to do so.
