1. This application for bail under Section 483 of BNSS has been filed by the petitioner who has been arrested in connection with F.I.R. No.134/2025 registered at Police Station Chitawa, District Deedwana-Kuchaman, for offences under Sections 85, 80(2) and

238 of BNS.

2. Learned counsel for the petitioner submitted that the petitioner, who is the father-in-law of deceased – Sangeeta, has falsely been implicated in the present case. Learned counsel submitted that as per the prosecution, the deceased – Sangeeta committed suicide by hanging herself within seven years of her marriage owing to mental and physical cruelty caused to her owing to demand of dowry.

3. Drawing attention of this Court towards the challan papers, learned counsel submitted that no specific allegation of dowry demand has been levelled against the present petitioner. Learned counsel submitted that the statements of various witnesses recorded by the investigating agency during the course of investigation, in particular the supplementary statements of complainant – Dinesh Kumar recorded by the investigating agency under Section 180 of the BNSS, indicate that the deceased was having some matrimonial disputes with her husband and owing to the same, she has committed suicide.

4. Lastly, learned counsel submitted that the petitioner, who is aged about 61 years, is in judicial custody; the investigation has already been concluded and the trial of the case will take sufficiently long time, therefore, the benefit of bail may be granted to the accused-petitioner.

5. Per Contra, learned Public Prosecutor has vehemently opposed the bail application and submitted that looking to the seriousness of the allegations levelled against the present petitioner, he does not deserve to be enlarged on bail.

Having considered the rival submissions, facts and circumstances of the case and having perused the challan papers and the statements of various witnesses, in specific, the supplementary statement of complainant – Dinesh Kumar recorded by the investigating agency under Section 180 of the BNSS and without expressing any opinion on merits/demerits of the case, this Court is inclined to enlarge the petitioner on bail.

7. Consequently, the bail application under Section 483 of BNSS is allowed. It is ordered that the accused-petitioner Gopal Ram S/o Roopa Ram arrested in connection with F.I.R. No.134/2025 registered at Police Station Chitawa, District Deedwana-

Kuchaman, shall be released on bail, if not wanted in any other case, provided he furnishes a personal bond of Rs.50,000/- and two sureties of Rs.25,000/- each, to the satisfaction of learned trial court, for his appearance before that court on each & every date of hearing and whenever called upon to do so till completion of the trial.

8. It is however, made clear that findings recorded/observations made above are for limited purposes of adjudication of bail application. The trial court shall not get prejudiced by the same.
