Order

16/02/2026 By way of filing the instant writ petition under Article 226 of the Constitution of India, the petitioner has prayed for the following reliefs:-

“It is, therefore, humbly and respectfully prayed that this writ petition of the petitioner may kindly be allowed: -

A/ By an appropriate writ, order or direction, the respondents may kindly be directed to award the khatedari rights of land in question in favor of the petitioner bearing land of khasra no. 30/2 measuring 19 Bigha Banjar Land situated as revenue village Kodamdesar, Tehsil Gajner (Colonization), District Bikaner.

B/ By an appropriate writ, order or direction, the respondent nos. 2 to 5 may kindly be directed to hold the meeting of allotment committee to decide the application of the petitioner for khatedari rights of land in question in mode of permanent allotment for the land of khasra no. 30/2 measuring 19 bigha banjar land situated at Revenue village Kodamdesar, Tehsil Gajner (Colonization) District Bikaner.

C/ By an appropriate writ, order or direction, the respondent officials may kindly be directed to convene the meeting of allotment committee to decide the claim of the petitioner in time bound manner and may kindly be directed to award khatedari rights of the land in question as per law of the governing field.

D/ Any other appropriate writ, order or direction which this Hon'ble Court may deem just and proper in the facts and circumstances in the case. E/ Writ petition filed by the petitioner may kindly be allowed with costs.”

After arguing the matter for some time, the learned counsel for the petitioner submitted that the petitioner would be satisfied if the competent authority of the respondents i.e. respondent Nos.2 to 5 are directed to consider and decided the petitioner’s case for grant of khatedari rights in accordance with law as expeditiously as possible.

In view of the aforesaid submission made at Bar by the learned counsel for the petitioner, the present writ petition is disposed of with a direction to the petitioner to file a fresh representation alongwith a certified copy of the order instant within a period of two weeks from today before the competent authority of the respondent department i.e. respondent Nos.2 to

5.

4. In case, a representation is so filed, the competent authority of the respondent department i.e. respondent Nos.2 to 5 shall consider and decide the request of the petitioner with regard to the grant of khatedari rights in accordance with law so also the provision of notification dated 28.05.2007 & 02.01.2008 issued by the Dy. Secretary to the Government Department of Revenue (Colonisation) Rajsathan, Jaipur within a period of eight weeks thereafter.

5. All pending applications, if any, also stand disposed of.
