1. The present writ petition is the second round of litigation and raises challenge to the impugned decision letter dated 21.11.2025 (Annexure-16), issued by the respondent—Pharmacy Council of India. By way of the said decision letter, the respondent rejected all the three courses offered by the petitioner-University, viz. Bachelors in Pharmacy (B. Pharm), Masters in Pharmacy (M. Pharm) and Diploma in Pharmacy (D. Pharm). The said decision letter, points out several deficiencies, which got revealed during the inspection conducted by the respondent on 12.11.2025. 2. Mr. Shashwat Purohit, learned counsel for the petitioner submits that the action of the respondent is absolutely illegal and mala fide. He further submits that a prior inspection conducted by the respondent on 10.05.2025 never pointed out any of the deficiencies as mentioned in the impugned decision letter dated

21.11.2025.

3. On the contrary, the inspection report dated 10.05.2025 recorded that the institute was found satisfactory for offering the course of D. Pharm, B. Pharm and M. Pharm. Thus, the deficiencies so pointed out in the impugned decision letter dated 21.11.2025 never ever existed and are not such which would have cropped up between the interregnum period of two inspections. Learned counsel further submits that this Court vide its interim order dated 17.10.2025 passed in S.B. Civil Writ Petition No.16092/2025 titled as Raffles University vs. Pharmacy Council of India, which was filed challenging the similar arbitrary actions of the respondent, stayed the decision of the respondent- Pharmacy Council of India regarding withdrawal of approval granted to the petitioner-University for the aforesaid three courses.

Learned counsel further submits that in response to the impugned letter dated 21.11.2025, the petitioner submitted a detailed representation dated 01.12.2025, addressing each and every issue raised by the respondent, however, no heed was paid to the same. It is further submitted that during the pendency of the writ petition, the respondent issued a subsequent letter dated 06.12.2025, a show-cause notice dated 10.12.2025 and an email dated 11.12.2025, which refers to certain decisions and meetings that were never communicated to the petitioner. Learned counsel finally submits that the entire action of the respondent is nothing but an act to overreach the interim order dated 17.10.2025 passed by this Court.

5. Taking note of the above, issue notice of the writ petition as well as stay application to the respondent by ordinary process as well as registered post, returnable by 29.01.2026.

6. Notices be given ‘dasti’ to learned counsel for the petitioner, as prayed.

7. In the meanwhile, the effect and operation of the impugned decision letter dated 21.11.2025, and all consequential actions arising therefrom, shall remain stayed and the respondent is directed to not take any coercive action against the petitioner in pursuance to the impugned decision letter dated 21.11.2025.

8. List the matter on 29.01.2026.
