1. Instant writ petition is preferred by petitioner with following prayer:

(a) by an appropriate writ order or direction the test report dated 10.12.2025 may be quashed and set aside and respondents may be directed to get re-measured height of petitioner by the independent Medical Board either at SMS Hospital Jaipur or at AIIMS, Jodhpur and if found suitable the respondents may be directed to appoint the petitioner on the post of Constable from the date of his lower meritorious candidate with all consequential benefits.

Considered submissions of learned counsel for petitioner wherein he submits that the height of the petitioner is 168.8 cm whereas Medical Board constituted by respondent No.3 has measured height of petitioner as 167.6 cm. He further submits that height of petitioner can be verified by a Medical Board.

Mr. Parth Sharma for Mr. Bhuwnesh Sharma, AAG accepts notice on behalf of respondents and candidly suggest that Medical Board at SMS Hospital, Jaipur may be directed to measure height and if the petitioner is found to be of requisite height, then he may submit a representation to respondent No.2, who shall consider the representation on the basis of report.

Having considered the submissions of learned counsel for parties and on perusal of material placed on record, without going into the veracity of the claim made by present petitioner and in order to balance the equity, and in the interest of justice, this Court deems it appropriate to direct the Superintendent, SMS Hospital, Jaipur to constitute a Medical Board to examine height of petitioner.

5. In view of aforesaid, the writ petition is disposed of with following directions:-

(i) The Superintendent, SMS Hospital, Jaipur is directed to constitute a Medical Board to examine and assess the height of present petitioner. The Medical Board shall prepare a report and send it directly to respondent No.2 and a copy to this Court.

(ii) The petitioner shall appear before the Medical Board/Superintendent, SMS Hospital, Jaipur on 29.12.2025 for medical examination in particular measurement of height.

(iii) If the height of the petitioner is found to be 168 CM or more in accordance with Clause 6 of the recruitment notification dated 09.04.2025, then the petitioner may submit a representation to respondent No.2, who shall consider the candidature of present petitioner and re-arrange physical fitness test as per rules.

6. The writ petition stands disposed with pending application, if any.
