HIGH COURT OF RAJASTHAN (JAIPUR BENCH)
Anoop Kumar Dhand, J
Avinash Sharma – Appellant
Versus
State Of Rajasthan – Respondent
S.B. Criminal Miscellaneous Application No. 605/2025
For the Appellants/Petitioners: Bhrigu Sharma
For the Respondents: Amit Punia-PP
A court order passed after hearing both parties is not subject to modification or clarification unless a manifest inadvertent error is established; the mere desire of a party to include additional evidence (CDR/Tower locations) does not justify modification.
Headnote:(A) Criminal Procedure - Modification of Order - Request for summoning additional Call Data Records (CDR) and tower locations - Where a specific order was passed after hearing parties and no inadvertent error is found, a subsequent application for modification to include additional phone numbers is not maintainable. (Para 6)
Issues: Whether the order dated 06.11.2025 required modification to summon the CDR and tower locations of additional police personnel.
