1. The petitioner has filed this interim bail application under Section 483 of BNSS in FIR No.214/2025 registered at Police Station Bhanipura, District Churu for offence under Sections 8/15, 25 of NDPS Act.

2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record.

3. Learned counsel for the petitioner submits that the petitioner is in judicial custody in connection with the aforesaid case. It is contended that the wife of the petitioner is in an advanced stage of pregnancy and, as per medical advice, requires constant care and emotional support, which can be provided only by the petitioner and the due date of delivery of petitioner's wife is 23.02.2026. Relevant medical documents have been placed on record. It is further submitted that the petitioner undertakes to surrender immediately after expiry of the interim bail period and shall not misuse the liberty so granted.

4. Per contra, learned Public Prosecutor opposes the prayer; however, he does not dispute the pregnancy of the petitioner’s wife.

Having considered the submissions made by the learned counsel for the parties and after perusing the material available on record, this Court is of the view that the aforesaid fact stands duly verified by the learned Public Prosecutor, based on the report forwarded by the concerned SHO, which affirms the same, therefore, without expressing any opinion on the merits of the case, this Court deems it appropriate to grant interim bail to the petitioner for a limited period of 15 days as the pregnancy of the petitioner's wife is in an advance stage and the presence of the petitioner is required for her care and well-being.

The petitioner Aakashdeep S/o Tarasingh is directed to be released on interim bail for a period of 15 days from 20.02.2026 to 06.03.2026, in connection with aforesaid FIR on his furnishing a personal bond in the sum of Rs.50,000/- with one surety of the like amount to the satisfaction of the Trial Court / Jail Authority, subject to the condition that the petitioner shall surrender before the concerned jail authorities immediately upon expiry of the interim bail period of 15 days, unless the period is extended by a competent court.

7. It is made clear that if the petitioner fails to surrender after the expiry of the interim bail period, the authorities shall be at liberty to proceed against him in accordance with law.

8. The interim bail application stands disposed of accordingly.
