1. This writ petition has been filed by the petitioner under Article 226 of the Constitution of India, seeking the following prayers:

“i) the action of the respondents while not including the name of petitioner in the merit list (Annexure-7) for recruitment on the post of Compounder/Nurse Junior Grade despite the fact that the petitioner secure more than the last cut off for to MBC (Male) category, is per se bad in eye of law, unjust, arbitrary, and violative to Articles 14, 15, 16 and 21 of the Constitution of India; and/or ii) the respondents may kindly be directed to include the name of the petitioner in the merit list (Annexure-7) while considering the documents of the petitioner as requisite documents and offer appointment to him on the post of Compounder/Nurse Junior Grade under MBC (Male) category in pursuance to the advertisement dated 10.12.2024 (Annexure-1);

and/or iii) Pass any other appropriate order which this Hon'ble Court may deem fit, just and proper in the facts and circumstances of the case in favour of the Petitioner.

iv) Cost of the writ petition be also awarded in favour of the Petitioner.”

Succinctly stated facts of the case are that the respondents issued Advertisement dated 10.12.2024 (Annex.1) for direct recruitment to 645 posts of Ayurved Compounder/Nurse (Junior Grade), with online applications closing on 15.01.2025; selection entailed 70% weightage to DAN&P marks and 30% bonus for experience (up to 30 marks). The petitioner (MBC Male), holding DAN&P (2015, Dr. S.R. Rajasthan Ayurved University, Jodhpur) and internship certificate, applied online and secured 47.56% marks exceeding the prior MBC (Male) cut-off of 47.17% placing him at Sr. No. 553 in the provisional merit list, which required submission of provisional certificate, marriage certificate, and renewed RANC registration by 27.05.2025; he complied fully, submitting the marriage and RANC certificates (issued 17.02.2025, applied for pre-deadline). Yet, the final list of 645 candidates excluded him despite including lower-scorers, citing absent RANC registration as on 15.01.2025, a hyper-technical bar amid administrative delay beyond his control. Representations yielded no relief, rendering the exclusion arbitrary and illegal.

Hence, this Writ Petition.

Learned counsel for the petitioner submits that the petitioner participated in the recruitment process pursuant to the advertisement (Annex.1) for appointment on the post of Ayurved Compounder / Nurse Junior Grade. He contends that the petitioner possessed the requisite qualifications as prescribed in the advertisement and accordingly submitted his application. It is further submitted that when the respondents published the provisional merit list (Annex.5), the petitioner's name appeared therein; however, a remark was recorded against his name stating: “Provisional, Marriage Certificate & New Renewal Registration Certificate Required”, and the last date for submission was provided as 27.05.2025. Counsel asserts that the petitioner complied with this requirement by duly submitting the registration certificate as well as the marriage certificate
