1. The present petition has been filed by the petitioner with the following prayer:-

"In view of the facts and circumstances stated above, it is most respectfully prayed that this Hon'ble Court may be pleased to:

A. That this Hon'ble Court may kindly issue an appropriate writ, order or direction, directing the respondent authorities to take immediate, effective and impartial action for removal of all illegal encroachments from Government land, including Charagah land and Gair Mumkin Rasta, particularly the Government land bearing Khasra No. 75 and other connected Government khasra numbers situated in Village Nimheda, Tehsil Peepalu, District Tonk, Rajasthan, strictly in accordance with law. B. That this Hon'ble Court may kindly direct the respondents to act in compliance with the law laid down by this Hon'ble Court in Jagdish Prasad Meena & Ors. vs. State of Rajasthan and other binding precedents, and to ensure protection, preservation and restoration of Government land and public way from illegal encroachments.

C. That this Hon'ble Court may kindly direct the respondents to conduct a fresh, independent and time- bound demarcation and survey of the Government land and adjoining private lands, in the presence of the petitioner, so as to clearly identify the encroached portion and restore the land to its original classification meant for public use.

D. That this Hon'ble Court may kindly direct the respondents to ensure free, unobstructed and permanent restoration of the public way over Government land for the use of the petitioner and villagers at large, and to restrain the private respondents from creating any obstruction or interference in future.

E. That this Hon'ble Court may kindly direct the respondents to take strict disciplinary and legal action against the erring revenue officials who have failed to discharge their statutory duties and have permitted illegal encroachment upon Government Charagah land and public way.

F. That this Hon'ble Court may kindly pass any other appropriate writ, order or direction as this Hon'ble Court may deem fit and proper in the facts and circumstances of the present case, in the interest of justice.”

2. Learned counsel for the petitioner submits that in the present matter, the petitioner has submitted a representation before the Tehsildar, Peepalu, District Tonk, however, no heed was paid to the said representation by the Tehsildar, Peepalu, District Tonk.

3. Learned counsel for the petitioner prays that the present writ petition be disposed of in light of the order dated 30.01.2019 passed by the Division Bench of this Court in the case of Jagdish Prasad Meena & Ors. Vs. State of Rajasthan & Ors. [D.B. Civil Writ Petition (PIL) No.10819/2018] with liberty to the petitioner to file representation(s) before the Public Land Protection Cell (hereinafter referred to as ‘PLPC’) constituted in compliance of the order passed in the case of Jagdish Prasad Meena (supra)
