1. This writ petition has been filed by the petitioner with the following reliefs:

“A. By an appropriate writ, order or direction, the order dated 24.07.2024 (Annex-15) may kindly be quashed and set aside.

B. The respondents may kindly be directed to consider the candidature of the petitioners for relaxation of upper age limit, in case the petitioners declared successfully in the interview then the respondents may kindly be directed to consider the petitioners appointment for the post of Sub Inspector of Police with all consequential benefits.

C. Any other appropriate writ, order or direction which this Hon'ble Court may deem just and proper in the facts and circumstances of the case may kindly be passed in favour of the petitioner.

E. Writ petition filed by the petitioners may kindly be allowed with costs.”

Brief facts of the case are that Respondent No.2 invited applications for recruitment to the post of Police Sub Inspector vide Notification No.69140 dated 25.11.2010, wherein the age limit was prescribed as a minimum of 20 years and a maximum of 25 years, with relaxation of up to 5 years for SC/ST and OBC candidates as per rules. This recruitment, held after 2007 (i.e., after more than three years without any prior process), rendered the petitioners overage; had it occurred earlier for post-2007 vacancies, they would have been within the upper age limit and entitled to consideration. Pursuant to the Rajasthan Different Service (Fourth Amendment) Rules, 2008 notified on 23.09.2008, candidates eligible by age in a year when no recruitment was held remain eligible for subsequent recruitments if they have not exceeded the upper age limit by more than three years. The petitioners' representations seeking such relaxation were forwarded by the respondent department to the Department of Personnel for sympathetic consideration, with at least ten posts still vacant under the process. Aggrieved by non-consideration, the petitioners filed S.B. Civil Writ Petition No. 13199/2019 seeking upper age relaxation and appointment with consequential benefits. In pursuance of this Hon'ble Court's order dated 21.11.2023 directing submission of details, the petitioners represented accordingly, but Respondent No. 1 rejected the same vide order dated 24.07.2024. Hence, this writ petition.

Learned Counsel for the petitioner submits that the respondents issued Advertisement dated 25.11.2010 (Annex.1) for the Sub-Inspector Police Combined Competitive Examination, 2010, the petitioner, being desirous of applying, submitted his application for the post of Sub-Inspector, however, he was overage at that time. He submits that since the recruitment occurred after a gap of more than three years, candidates like the petitioner have been granted relaxation in the upper age limit, however, the respondents failed to extend the same to the petitioner. Aggrieved thereby, the petitioner approached this Court vide S.B.C.W.P.

No.6289/2019 (Ashok Kumar & Ors. v. State of Rajasthan & Anr.), which was disposed of vide order dated 21.11.2023 while directing the petitioner to approach the respondents with a representation and the respondents were directed to decide the same expeditiously.
