1. At the request of the learned counsel for the petitioner, this writ petition has been taken up for final disposal at the admission stage.

2. The limited grievance of the petitioner is that he has challenged the order dated 06.11.2025 (Annex.4) whereby, the petitioner was reverted back from the post of Head Constable (MT) to Constable (Mt).

The case of the petitioner is that the petitioner was initially recruited in the cadre of Constable (MT) and the seniority list of such Constables (MT) was originally prepared in the year 2013- 2014. Based on the said seniority list, the petitioners were promoted to the post of Head Constable (MT) in the year 2017.

4. Some of the Constables challenged the said seniority list prepared in the year 2013-2014. The writ petition filed by such Constables (MT) was allowed and the seniority list was directed to present petitioner was sought to revert back to the post of Constables (MT).

5. The grievance of the petitioner is that even in the changed seniority list, the person junior to the petitioner in the newly/fresh prepared seniority list, have already been promoted in the subsequent year and they were holding the post of Head Constables (MT).

6. The learned counsel appearing for the petitioner submits that his limited grievance is that the petitioner, instead of reverting back to the original post of Constables (Mt), their year of promotion can be changed to the year when juniors were promoted to the post of Head Constables (MT).

In the light of the limited grievance, without going into the merits of the case, whether the juniors were promoted basing on the new/fresh seniority list, the petitioner is required to be retained in the same promotional posts changing the year of promotion to the year when their juniors were promoted.

In the said circumstances, the instant writ petition is disposed of with a liberty to the petitioner to file their representation indicating the persons, who were juniors to him in the new/fresh seniority list and year of promotion. If the juniors of the petitioner are holding the promotional posts of Head Constables (MT), present petitioner shall be treated to be promoted in the same year in which the juniors of the petitioner were promoted based on the existing seniority list. The respondents are directed to pass appropriate orders on such representation within a period of one month from the date of receipt of a copy of this order.

Till then, the petitioner shall not be reverted back from the post of Head Constables (MT) to the original post of Constables (MT) and consequently, if the petitioner is found to be entitled to be retained on the promotional posts, the demotion order shall be reviewed accordingly and the respondents shall pass appropriate orders, in accordance with law.
