1. The application (I.A. No.01/2026) has been filed seeking extension of the interim/temporary bail granted by this Court vide order dated 14.08.2025 passed in S.B. Criminal Writ Petition No.157/2025.
2. Learned counsel for the petitioner submits that earlier the petitioner was granted three months interim bail to undergo knee replacement surgery vide order dated 14.08.2025. The surgery for one knee replacement was undertaken whereas, same could not be performed in relation to another knee, therefore, the period of interim bail was extended for further three months for surgery of left knee replacement. Learned counsel further submitted that due to advanced age and some medical complication knee replacement surgery could not be done. Now, the tentative date for surgery has been fixed as 23.02.2026. It is, therefore, prayed that the period of interim bail granted to the petitioner may be extended for a further period of six months for the purpose of left knee replacement surgery.
3. Vide order dated 11.02.2026, learned Public Prosecutor was directed to procure petitioner’s medical report. Today, learned Public Prosecutor has submitted a report dated 14.02.2026 received from SHO, Police Station Kotwali, District Sirohi alongwith medical report. The medical report dated 21.01.2026 reflects that date of admission has been given as 22.02.2026 and the tentative date of surgery is scheduled as 23.02.2026.
4. After considering the overall facts and circumstances of the case and upon careful perusal of the material available on record, this Court deems it appropriate to extend the interim bail/temporary bail of the petitioner for a further period of
90 days
5. In this background and for humanitarian grounds and there being no legal impediment to extend the period of interim bail, the instant application is allowed and the period of interim bail already granted by this Court, vide order ibid, is hereby extended for 90 days. The petitioner Bharat Das Vaishnav S/o Mandas, shall be released on interim bail for further period of 90 days’ on the same conditions/directions and the bail and bonds furnished by him in terms of the order dated 14.08.2025.
6. It is made clear that instant order shall be applicable qua all the FIRs, the recital of which has been given in the present application.
7. Learned Public Prosecutor is directed to procure the status report/case diary/factual report with regard to the surrender of the petitioner before the Jail Authorities by the next date of hearing.
8. List the matter on 18.05.2026.
