1. Vide order dated 19.02.2026, this Court directed the petitioner to appear before AIIMS Hospital, Jodhpur with the direction to the Director of AIIMS was directed to constitute a Medical Board to examine the petitioner’s fitness qua the deficiency regarding colour vision. In compliance of the said order, a medical report dated 23.02.2026 has been produced before the Court in a sealed cover, which has been opened in Court.

2. On a perusal of the report, this Court finds that the Medical Board has opined that “On examination, the Medical Board has found that Sh. Rahul Patidar S/o Sh. Sukh Lal Patidar has defective colour vision.” The said report is taken on record.

3. Instant writ petition has been filed by the petitioner seeking the following reliefs:

“a) Quash and set aside the rejection of the Petitioner by the Respondent Department on the basis of the Physical Fitness Certificate and alleged colour vision deficiency;

b) Direct the Respondent Department to reinstate the Petitioner's candidature for the post of Constable, 2025, and allow the Petitioner to join the service without any further delay;

c) Declare that the Petitioner has no colour vision deficiency or any disability as alleged by the Respondent Department, and that the rejection was arbitrary, unjust, and stigmatic in nature;

d) Issue any further or other orders as this Hon'ble Court may deem fit and proper in the interest of justice.”

4. The petitioner’s candidature has been rejected by the respondents vide impugned order dated 29.01.2026 (Annex.-10), concluding that the petitioner was found to have colour vision deficiency on lantern test.

The petitioner got himself examined at Rajkiya Mahatma Gandhi Jila Chikitsalaya, District Banswara (Annex.-8), where the concerned doctor opined that the petitioner is not suffering from colour deficiency; and at Sawai Man Singh Hospital, Jaipur (Annex.-9), where his report was also found negative. With the said reports, the petitioner approached the respondents and the respondents thereafter, again subjected the petitioner to re- examination by the Medical Board at SMS Jaipur Hospital, on the basis of which, the petitioner was found to have defective colour vision, leading to rejection of his candidature.

7. In view of the contradictory reports, the petitioner was directed to appear before AIIMS, Jodhpur. The Medical Board of AIIMS Hospital, Jodhpur, has now found the petitioner to have defective colour vision. Therefore, the relief prayed for by the petitioner cannot be granted. Learned counsel for the petitioner is also not disputing the report of AIIMS, Jodhpur. The writ petition lacks merit and is accordingly dismissed.
