Order
23/02/2026 This Court on 06.02.2026 passed a detailed order in the presence of ACS, Home and other senior police officials, whereby they were directed to file a detailed affidavit with regard to the steps taken for compliance of the directions as issued by this Court vide order dated 27.11.2025 in S.B. Criminal Misc. Bail Application No.7940/2025. The matter was then fixed for
23.02.2026 as requested by the above officials.
Till today, no affidavit, in compliance of the order dated
06.02.2026, has been filed, however, an application for extension of time to file the affidavit has been filed today in the Registry. A photocopy of the application has been provided to this Court.
By the application it has been informed to this Court that the State has recently taken certain steps for establishment of Cyber Police Station in Jodhpur Rural, Jaipur Rural, Kota Rural, Jodhpur and Jaipur Police Commissionerate and for creation of Cyber Division in Regional Forensic Science Laboratories as per the Information Technology Act, 2000 in Jodhpur, Bharatpur, Kota including Jaipur.
It has also been informed to this Court that though allocation of funds has already been made by the Government in State-Budget, however, the same are yet to be received.
From the contents of the application and other facts as informed by GA-cum-AAG, Mr. Rajesh Choudhary, this court has noted that in tune with the directions issued by this Court on 27.11.2025, the State Government is also acting fast in establishment of more Cyber Police Stations in Rajasthan, as mentioned above to deal with the serious issue of cyber crime, which is increasing at a fast pace in the State.
It has also been informed to this Court by Mr. Rajesh Choudhary, GA-cum-AAG that the State Government has also taken a decision to open Cyber Courts in all the Districts for which necessary approval has also been granted, however, the appointment of Judicial Officers and other staff in respect of the same will take place after receiving the allocated fund.
In the application, as filed today for extension of time, there is no specific prayer with regard to the exact time as required, however, an oral request has been made for grant of four weeks’
time.
Looking to the serious problem of cyber crime, the issues which are troubling the entire country, this Court also issued the detailed directions, so as to have a complete infrastructure in the State of Rajasthan to handle the serious issue, vide order dated 27.11.2025. This Court noted, while interacting with the ACS, Home, DG Cyber and other senior police officials who were present before this Court on 06.02.2026, in reference to compliance of the directions dated 27.11.2025, the ACS Home, DGP and DG, Cyber along-with other concerned Departments are working in complete co-ordination to have the complete infrastructure at the earliest in the State as they are facing serious problems in respect of law and order in taking various steps to prevent, investigate and prosecute in the matter of cyber crimes in the State due to lack of sufficient and required infrastructure.
This Court issued the directions dated 27.11.2025 while hearing various bail applications pertaining to cyber crimes, in which it was noticed that no proper investigations have been made as the investigating officers in FIRs related to cyber crime are neither equipped with any kind of training nor they have any technical knowledge.
