1. Despite service, none appears on behalf of the sole respondent.

By way of present transfer application under Section 24 of the CPC, applicant-wife of the respondent, seeks transfer of application under Section 13 of the Hindu Marriage Act bearing Family Main Case No.46/2025 (Pawan Kumar versus Lalita Joshi Urf Samta), currently pending before the Court of learned Family Court (Additional District & Session Judge No.1), Kekri, Ajmer to the Court of learned Additional District & Session Judge, Gulabpura, Bhilwara.

3. Heard learned counsel for the petitioner.

4. Learned counsel for the applicant submitted that respondent has filed an application under Section 13 of the Hindu Marriage Act Session Judge No.1) Kekri, Ajmer. It is submitted that applicant is a young woman and having responsibility of two sons who are residing with her. She is facing considerable hardship in travelling from Bhilwara to Ajmer, a distance of approximately 135 kms, for the purpose of attending regular hearings. It is further submitted that such repeated travel places a financial burden upon the applicant, who is a destitute woman presently residing with her elder sister. The applicant is wholly dependent upon her sister for shelter and sustenance, as she is having meager income and is not having sufficient financial means to secure basic necessities, including adequate provision for her child’s education and other essential amenities. Owing to these circumstances, it is extremely difficult for the applicant to undertake travel on each and every date of hearing to attend the proceedings initiated by the respondent at Ajmer. It is further submitted that the applicant has also instituted criminal prosecution, which is pending investigation at PS Gulabpura, District Bhilwara. Therefore, it is prayed that the said case be transferred for the convenience of the applicant.

6. I have considered the arguments advanced by the learned counsel for the petitioner and meticulously perused the record.

Having regard to the aforementioned judicial pronouncement, the facts and circumstances of the present case, and the cogent grounds advanced in the transfer application, this Court finds it just and expedient to allow the application. Accordingly, the Family Main Case No.46/2025 (Pawan Kumar versus Lalita Joshi Urf Samta), currently pending before the Court Kekri, Ajmer is hereby ordered to be transferred to the Court of for adjudication.

Ajmer is directed to transmit the entire case record forthwith to the Court of Additional District & Session Judge, Gulabpura, Bhilwara. Additionally, it is further directed to compile and list all matrimonial and related cases pending, if any, between the parties before the said Court, both on the date of transfer and thereafter, to facilitate consolidated and efficient disposal.

It is further directed that if any case relating to the matrimonial dispute between the present parties is pending before any Court in Bhilwara, the Presiding Officer of the said Court shall fix hearing of the said case on the same date when the transferred case is posted so that no inconvenience is caused to any of the parties. Such cases shall be proceeded simultaneously but separately.

10. The learned Additional District & Session Judge, Gulabpura, Bhilwara or the Family Court, where the case is transferred, shall make all efforts for reconciliation between the parties and only thereafter proceed with the matter and decide the same in accordance with the timeline prescribed under the law. 11.
