1. The present bail applications have been filed by the accused- petitioners under Section 483 of B.N.S.S. in connection with F.I.R. No.589/2025 registered at Police Station Kaman, District Deeg, for the offence(s) punishable under Section(s) 319(2), 318(4), 338, 336(3), 340(2), 111 & 61(2) of B.N.S. and Section(s) 66D and 67A of I.T. Act.

2. Learned counsel for the petitioners submits that the accused- petitioners have been falsely implicated in this case and they have nothing to do with the alleged offences. Learned counsel further submits that petitioners have no criminal antecedent, they are in custody since 21.11.2025 and no recovery is required to be made from them. He also submits that charge-sheet has already been filed in the matter and trial will take considerably long time in its conclusion, so no fruitful purpose would be served by keeping the petitioners into custody, therefore, they may be enlarged on bail.

Per contra, the learned Public Prosecutor opposes the submissions made by learned counsel for the petitioners and submits that petitioners are involved in serious offences involving cyber fraud activities. He further submits that one complaint is registered each against two petitioners namely, namely Mustak S/o Kanwa @ Fajru, and Vishal S/o Banarasi, on National Cyber Crime Reporting Portal (N.C.R.P.).

Taking into consideration the overall facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioners, the fact that charge-sheet has already been filed, petitioners have no criminal antecedents and trial will take considerably long time in its conclusion, thus, without commenting anything on the merits / demerits of the case, this Court deems it just and proper to enlarge the petitioners on bail.

Therefore, the instant bail applications are allowed and the accused-petitioners, namely (1) Mustak S/o Kanwa @ Fajru (2) Vishal S/o Banarasi and (3) Mursalim S/o Dhammu, are ordered to be released on bail, provided, each of them furnishes a personal bond in the sum of Rs.1,00,000/- with two sureties of Rs.50,000/- each to the satisfaction of the Trial Court, with the following conditions:-

(i) The accused-petitioners shall not tamper with evidence or influence the witness in any manner.

(ii) The accused-petitioners shall not indulge in any criminal activity and shall not repeat any criminal offence punishable under the Law.

(iii) The accused-petitioners shall attend the hearing of the Trial Court on the date fixed by the Trial Court or as and when they are asked to appear before the Trial Court.

6. The accused-petitioners are directed to mark their presence on 12^th day of every month till conclusion of trial before the concerned Police Station. The SHO of the concerned Police Station shall send the presence report of the accused-petitioners to the Trial Court on the same da
