Order

23/02/2026 The matter comes up on an application (I.A. No.01/2026)

under Section 151 of CPC for extension of time for making compliance of the interim order granted by this Court on

24.04.2025.

2. This Court, vide order dated 24.04.2025, while granting interim order, passed the following order:

"4. In the meantime, effect and operation of the judgment and decree dated 26.03.2025 passed by learned Additional District Judge No.2, Abu Road, district Sirohi in Civil Original Suit No.29/2018 (11/2017) (CIS No.15/2017) shall remain stayed subject to the condition that the appellants- defendants shall deposit an amount of Rs.11,00,000/- (Rupees Eleven Lakhs) before the trial court within a period of three months from today.

5. In case the appellants-defendants fail to deposit the aforesaid amount within the stipulated period, the interim protection granted by this Court shall stand vacated automatically.

6. In case the appellants-defendants deposit the said amount with the trial Court within the stipulated period, the trial Court shall ensure disbursement of the said amount to the respondents-plaintiffs in accordance with law.

7. The respondents-plaintiffs shall file an undertaking before the learned trial Court that in case the appeal succeeds, they shall refund the amount so received by them along with interest as per applicable rate."

Thereafter, learned counsel for the appellant moved an application for extension of time for making compliance with the conditions imposed in the interim order dated 24.04.2025 and the Court, while allowing the same, granted last opportunity to deposit the amount in question. Learned counsel for the appellant again moved an application for further extension of time which was also allowed by this Court vide order dated 29.10.2025.

4. Now, the present application has been filed by learned counsel for the appellant again seeking further extension of time for making compliance with the order dated 24.04.2025.

5. It is noted that the matter was subsequently listed on 14.11.2025 before a Co-ordinate Bench of this Court. On that day, even though none appeared on behalf of the respondent, the interim order dated 24.04.2025 was made absolute and the stay petition was disposed of vide order dated 14.11.2025 in the presence of learned counsel for the appellant himself.

6. In view of the fact that the stay petition has already been disposed of, no question arises regarding extension of time for compliance of the interim order dated 24.04.2025.

7. Accordingly, the present application seeking extension of time for making compliance with the interim order dated

24.04.2025 is rejected.

8. List the matter for final hearing.
