1. The present bail application has been filed by the accused- applicant under Section 483 of the B.N.S.S, 2023 against the order dated 15.10.2025 passed by learned Additional District and Sessions Judge, Jayal District Nagour in connection with FIR No.34/2025, registered at Police Station Jayal, District Nagour for the offences punishable under Sections 103(1), 109(1), 121(1), 132, 324(3)(5), 238(A) of the BNS and 3 of P.D.P.P. Act and 3/25 of Arms Act, by which the bail application of the accused-applicant under Section 483 of the B.N.S.S, 2023 has been dismissed.

accused-applicant has falsely been implicated in this matter. prosecution story, the accused-applicant was driving a Fortuner car bearing registration No. RJ 21 UV 7722 at about 11:00 PM. On the date of the incident, the police were on patrolling duty. According to the FIR, the police officer asked the driver of the Fortuner vehicle to stop the car, but the accused-applicant fled from the spot. When the police followed the Fortuner vehicle in their official vehicle and tried to overtake it, the driver of the Fortuner car collided with the police vehicle. The police vehicle also struck a signboard on the roadside. The police officer sitting in the vehicle sustained injuries. In the said incident, one Prahalad Ram died and some other police officers also sustained injuries. Learned counsel for the petitioner further submits that as per the prosecution story, it is not mentioned that the Fortuner car was carrying any contraband, nor that the persons in the vehicle were fleeing from any offence. There was no motive assigned to the accused-applicant to commit the murder of a police officer. The incident occurred suddenly, most likely due to speedy driving and the accident between the police vehicle and the Fortuner car occurred in the process of overtaking the police vehicle. Therefore, no criminal intention to commit murder can be attributed to the accused-applicant. Furthermore, the accused-applicant has been implicated in this case solely on the basis of a notice under Section 133, which was issued to the registered owner of the fortuner. The present applicant- Ramwilas, was not named as the driver of the car on the date of the incident. The accused-applicant was not identified at the spot and no identification parade has been conducted. Learned counsel also argues that the accused- applicant was arrested on 03.04.2025 and since then, he is behind the bars. Learned counsel further contends that charge-sheet has been filed. Learned counsel prays that trial will take long time to conclude, therefore, the accused-applicant be enlarged on bail.

3. On the other hand, learned Public Prosecutor vehemently oppose the bail application.

4. Heard learned counsel for the parties and also perused the material available on record.

Having regard to the facts and circumstances of the case and considering the facts that the accused-applicant is behind the bars since 03.04.2025; that the charge-sheet has been filed and trial will take long time to conclude, without expressing any opinion on the merits/demerits of the case, this Court deems it proper to allow the bail application filed by the accused-applicant.

6. Consequently, this bail application filed under Section 483 of the B.N.S.S, 2023 is allowed. It is ordered that accused-applicant Ramwilas Dhojak @ Kaluram S/o Budharam arrested in FIR No.34/2025, registered at Police Station Jayal, Distri
