1. Present writ petition has been filed challenging order dated 28.06.2024 passed by learned Board of Revenue (Annexure-10), whereby learned Board of Revenue stayed order dated 14.06.2024 directed the parties to maintain status quo.

2. Petitioner has challenged said order dated 28.06.2024 on the ground that order dated 14.06.2024 passed by the learned Revenue Appellate Authority was merely an ad-interim order, and since it was not a final order, revision petition itself was not maintainable.

3. This Court vide order dated 16.08.2024 has stayed effect and operation of order impugned dated 28.06.2024.

4. Learned counsel for respondents fairly accedes to the legal objection raised by counsel for petitioner while challenging the impugned order; however, he prays that appropriate directions be issued to learned Revenue Appellate Authority to decide the pending appeal expeditiously. Counsel for the respondent also does not oppose the continuation of interim order dated

16.08.2024 passed by this Court.

5. In view of the consent given by the parties, the present writ petition is allowed. Impugned order dated 28.06.2024 passed by learned Board of Revenue (Annexure-10) is set aside. Consequently, revision petition filed by respondent Madho Singh stands dismissed.

6. Counsel for the parties are directed to submit a copy of this order before learned Board of Revenue so that Revision Petition No. 4286/2024 may be formally dismissed and file be consigned to the record. Record of learned trial Court or learned Revenue Appellate Authority, if received by learned Board of Revenue, shall be transmitted back to the concerned Court forthwith.

Till the time Revenue Appellate Authority decides the appeal preferred by petitioner, parties are directed to maintain status quo with regard to land in question. Revenue Appellate Authority shall make all endeavours to decide the pending appeal within the stipulated period, without granting unnecessary adjournments to either of the parties and without being influenced by any observations made by this Court in the present order, and shall decide the appeal strictly in accordance with law.
