1. Present writ petition has been filed praying for directions to be issued to respondent-State Government to grant NOC to Petitioner-Institution for undertaking GNM Course and further to include Petitioner-Institution in counseling process for academic session 2024-25.

2. Explaining the factual background, learned counsel for the petitioner submitted that in case of Petitioner-Institution, inspections have already been undertaken on two occasions; however, the issue regarding grant of NOC to Petitioner-Institution has not been finalised, which has necessitated filing of present writ petition.

3. Learned counsel for the petitioner has drawn attention of this Court to order dated 14.01.2025 passed by this Court in S.B. Civil Writ Petition No. 18978/2024, whereby directions were given to respondents to decide pending applications/representation for grant of necessary permission/

NOC within a period of six weeks.

This Court, vide orders dated 12.03.2025, 18.04.2025, 14.10.2025, 03.11.2025 and 18.11.2025, granted adjournments at the request of learned counsel for the respondents; however, response/reply had not been filed by respondents. Thereafter, this Court, vide order dated 05.02.2026, granted last opportunity to respondents to place on record compliance report of order dated 14.01.2025 passed by this Court in S.B. Civil Writ Petition No. 18978/2024, and it was made clear that if compliance report is not filed, the Principal Secretary, Medical and Health Department, shall remain present before this Court on 25.02.2026.

5. Today, in compliance of said directions, Ms. Gayatri Rathore, Principal Secretary, Medical and Health Department, appeared through video conferencing. Various other writ petitions involving similar issues regarding timely completion of the process for grant of NOC to institutions are also listed before this Court; accordingly, learned counsel appearing in those matters were also present and made their submissions.

6. Principal Secretary, Medical and Health Department, submitted that since a large number of applications, approximately 676, have been received for grant of NOC for GNM/ B.Sc. Nursing courses, State authorities are currently in the process of taking a final decision regarding said applications. It was further submitted by Principal Secretary that, considering the large number of applications received, matter has been referred to a Higher Level Committee, which shall take a final policy decision regarding the requirements for establishment of such institutions, while taking into account factors such as geographical location of proposed institutions and availability of existing colleges in concerned areas. It was stated that a minimum of three months’ time would be required for the Higher Level Committee to resolve the issue and for deciding pending applications for grant of NOC for respective courses.
