1. These instant bail applications have been filed under Section 483 BNSS on behalf of accused-petitioners. The petitioners have been arrested in connection with FIR No. 290/2025 registered at Police Station Keshrisinghpur, District Sriganganagar, for the offence(s) under Sections 8/21 & 8/25 of NDPS Act.
2. Learned counsels for the accused-petitioners submits that the accused-petitioners have falsely been implicated in this case.
It is contended that the recovery of contraband article smack weighing 24 grams, which is below commercial quantity, was effected after personal search of other co-accused Kishan. No recovery of any contraband article was effected from the present accused-petitioners. The accused-petitioners have been implicated wholly on the basis that their presence was found with the other co-accused Kishan in a vehicle. The Petitioners are behind the bars since 25.12.2025 and charge-sheet has already been submitted. The trial of the case may take considerable time, therefore, these bail applications of the accused-petitioners may be allowed.

Learned Public Prosecutor has vehemently opposed these bail applications and contended that both the accused-petitioners are habitual offenders and against them, several cases including cases of NDPS Act were registered, therefore, considering the aforesaid facts, these bail applications filed by the accused-
petitioners deserve to be dismissed.
4. Heard and perused the material available on record.

It is not denied that the recovery of 24 grams of smack was effected after personal search of co-accused Kishan and no recovery of any contraband article was effected from the personal search of the present petitioners. Though, there are several cases against the petitioners under NDPS Act, however, considering the aforesaid facts including the fact that the petitioners are behind the bars since long and the trial of the case may take considerable time, without further elaborating the merits of the case, this Court deems it just and proper to enlarge the accused-petitioners on bail.
6. Accordingly, these bail applications under Section 483 BNSS are allowed and it is ordered that the accused-petitioners namely: 1. Sunita W/o Jitendra and 2. Sunil Kumar S/o Mukand Lal, in connection with FIR No. 290/2025 registered at Police Station Keshrisinghpur, District Sriganganagar, shall be enlarged on bail provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing and as and when called upon to do so. The learned trial Judge shall also verify the address and the contact details of the surety through concerned SHO before releasing the accused-petitioners on bail.
7. The accused-petitioners are also directed to mark their presence on 25th of every month till conclusion of trial before the concerned police station. The SHO of the concerned police station is directed to maintain a regular register marking the presence of the accused-petitioners and shall send the presence report of the accused-petitioners on the same day to
