Interim bail may be extended on humanitarian grounds when medical reports verify a scheduled necessity for surgery, provided there is no legal impediment.

1. The application (IA No.01/2026) has been filed seeking extension of period of interim/temporary bail granted by this Court vide order dated 07.08.2025.

2. The petitioner, who is present in person, submits that earlier he was granted interim bail for undergoing left knee replacement surgery, which was extended by this Court. However, due to certain medical complications, the surgery of left knee replacement could not take place. It is further submitted that the doctor has now advised him to undergo the surgery on 14.03.2026, for which he is required to be admitted in the hospital on 13.03.2026. He further submits that his medical parameters are now stable. In support thereof, medical documents have been placed on record, which reflect that the petitioner is undergoing treatment for a left knee replacement.

In pursuance of the order dated 06.03.2026, learned Public Prosecutor has submitted the latest medical report dated 07.03.2026 sent by the SHO, Police Station Kotwali, Sirohi and submits that as per the latest medical report, the petitioner is required to be admitted to the hospital on 13.03.2026 and the knee replacement surgery is scheduled on 14.03.2026. The said report is taken on record.

4. Learned Public Prosecutor has opposed the prayer for grant of temporary/interim bail; however, he is not in a position to dispute the fact that the petitioner’s knee replacement surgery is scheduled on 14.03.2026.

After considering the overall facts and circumstances of the case and upon careful perusal of the material available on record, more particularly the latest medical reports as well as the date of surgery scheduled on 14.03.2026, this Court deems it appropriate to extend the interim/temporary bail of the petitioner for a further period of four months.

In this background and for humanitarian grounds and there being no legal impediment to extend the period of interim bail/temporary, the instant application is allowed and the period of interim bail already granted to the petitioner Mukesh Modi S/o Late Prakash Raj Modi, by this Court, vide order ibid, is hereby extended for a further period of four months on the same conditions/directions and the bail and bonds furnished by him in terms of the order dated 07.08.2025.

7. It is made clear that instant order shall be applicable qua all the FIRs, the recital of which has been given in the present application.

8. Learned Public Prosecutor is directed to procure the status report/factual report with regard to the surrender of the petitioner before the Jail Authorities by the next date of hearing.

9. List the matter on 13.07.2026.

10. It is made clear that the petitioner has already been granted extension of interim bail on two earlier occasions on the same ground. Therefore, this Court grants one last opportunity to the petitioner to undergo the scheduled surgery and complete all other medical requirements.
