1. By way of filing the present writ petition, the petitioner has prayed for the following reliefs:-

“It is, therefore, most respectfully and humbly prayed that the instant writ petition may kindly be ordered to be allowed and;

i) By an appropriate writ, order or direction, the impugned order dated 29.01.2024 Annex.7 may kindly be quashed and set aside and entire impugned proceedings in the form of appeal may kindly be ordered to be quashed and set aside.

ii) Any other order of direction, which this Hon'ble Court deems fit and proper in the facts and circumstances of the present case may kindly be passed in favour of the humble petitioner.

iii) Cost of the writ petition may kindly be awarded in favour of the humble petitioner.”

Having heard learned counsel for the parties and having perused the material available on record, this Court finds that the private respondents, i.e., Balbir Singh, Chetan Prakash, Chandra Shekhar, all are sons of Roop Singh, have preferred an appeal under Section 90-A(9) of the Rajasthan Land Revenue Act, 1956, challenging the order dated 25.07.2023 (Annexure-2) passed by the Commissioner (Zone-VI), JDA, Jodhpur before the learned Divisional Commissioner, Jodhpur by way of filing Revenue Appeal No.06/2024, whereby the land allegedly belonging to the petitioners situated at Khasra No.1583/7 was converted from agricultural to residential purposes.

3. The case of the present petitioners are that after conversion of the said land, pattas have also been issued in favour of individuals by the Jodhpur Development Authority (JDA), Jodhpur. As per the petitioners, despite the fact that they were necessary and proper parties to the Revenue Appeal No.06/2024 pending before the Divisional Commissioner, the private respondents, without impleading them as parties in the matter, have not only filed the appeal but the Divisional Commissioner has also passed an interim order directing the parties to maintain status quo in relation to the land in dispute.

This Court, vide order dated 26.02.2024 while issuing show- cause notice upon respondents, has been pleased to stay the effect and operation of the order dated 29.01.2024 (Annexure-7) passed by the Divisional Commissioner, Jodhpur in Revenue Appeal No.06/2024. It is not in dispute that during the pendency of the present writ petition, upon an application filed by the private respondents, the petitioners have been impleaded as party respondents in the Revenue Appeal No.06/2024 pending before the Divisional Commissioner, Jodhpur.

In that view of the matter, the present writ petition is disposed of with a direction to the Divisional Commissioner, Jodhpur to decide the Revenue Appeal No.06/2024 pending before it, as expeditiously as possible, after hearing the petitioners as well as the private respondents, and while deciding the appeal, the Divisional Commissioner, Jodhpur shall also take into con
