1. By way of filing the present writ petition, the petitioner has prayed for the following reliefs:-

“It is, therefore, most humbly and respectfully prayed that this writ petition may kindly be allowed:-

a) By an appropriate writ, order or direction, it may kindly be declared that the order dated 23.11.2017 (Annex-5) passed by the Executive Engineer, Water Resources, Division-II, Hanumangarh is illegal and same may kindly be quashed and set aside.

b) By an appropriate writ, order or direction, the Chak plan (Annex-2) prepared by the respondent no. 4 may kindly be declared illegal upto the extent of water course of Kila no. 5 to 1 and Kila no. 1, 10, 11, 20 & 21 of Murba no. 40 (Stone no. 209/298).

c) By an appropriate writ, order or direction, the respondent irrigation department may kindly be restrained to construct the masonry water course of Kila no. 5 to 1 and Kila no. 1, 10, 11, 20 & 21 of Murba no. 40 (Stone no. 209/298).

d) By an appropriate writ, order or direction, the respondent irrigation department may kindly be directed to construct the masonry water course from Kila no. 1 to 5 of Murba no. 46 (Stone no. 210/299) and Kila no. 1 to 5 of Murba no. 45 (Stone no. 209/299) for providing the water facility to the land of the petitioner.

e) Any other appropriate order or relief which this Hon'ble Court may deem just and proper in the facts and circumstances of this case may kindly also be passed in favour of the humble petitioner.”

Having heard learned counsel for the parties and having perused the material available on record, this Court deems it just and proper to dispose of the present writ petition with a direction to the petitioner to file a detailed representation before the respondent No.4 – Executive Engineer, Gangnehar OFD, Division- VII CDA, Sriganganagar, with a prayer to construct the machinery water course from Kila No.1 to 5 of Murabba No.46 (Stone No.210/299) and Kila
