1. By way of filing the instant writ petition under Article 226 of the Constitution of India, the petitioners have prayed for the following relief:

“It is, therefore, respectfully prayed that,-

a) by an appropriate writ, order or direction, this petition may kindly be allowed with costs and issue an appropriate writ, order or direction, in the nature of mandamus or any other writ deemed just and proper by this Hon'ble Court, directing the Respondents to immediately generate and issue the valid Crop Insurance Policy for the Petitioner's Kharif 2025 crop, for which the insurance premium has already been duly deducted from the Petitioner's loan account.

b) Further direct the Respondents to consider and process the Petitioner's claim for compensation under the Pradhan Mantri Fasal Bima Yojana (PMFBY) for Kharif 2025, in respect of the total loss of the Petitioner's Moong (Green Gram) crop, strictly in accordance with the applicable guidelines, circulars, and notifications issued by the Government of India and the State Government.

c) by an appropriate writ, order or direction, the action of the respondents in not making the payment of compensation in lieu of insurance premium deducted by the bank in regard to failure of the Kharif crops 2025 may kindly be set aside and the respondents may kindly be directed to pay the claim amount of insurance of Kharif crops year 2025 due to failure of crops with the interest @ 12% per annum.

d) That any order passed or action taken by the respondents denying claim of kharif insurance-2025 to the petitioner may be quashed and set-aside.

e) Any other appropriate order or direction, which this Hon'ble Court deem just and proper be passed in fever of the petitioners.”

2. After hearing the learned for the petitioner, this Court deems it just and proper to dispose of the present writ petition with a direction to the petitioner to submit a detailed representation before the respondents Nos.1 and 2 within a period of 15 days, for ventilating his grievances. Upon receipt of such representation, the respondents Nos.1 and 2 shall consider the same in conformity with the Office Memorandum dated 09.09.2020 issued by the Ministry of Agriculture and Farmers Welfare, Department of Agriculture, Cooperation and Farmers Welfare under subject “Constitution of Committee for settlement of additional claims arising due to problems/mistakes/errors/ omissions under Pradhan Mantri Fasal Bima Yojana (PMFBY) and Restructure Weather Based (RWBCIS), within a period of eight weeks thereafter.
