09/03/2026 Learned counsel for the petitioner has submitted that the petitioner is aggrieved of the order of termination of his service dated 09.02.2026. It is submitted that while carrying out the recruitment, he has furnished the required certificate issued by competent authority, whereby he was certified as physically disabled. It is submitted in spite of the same, the respondent authorities have certified him to be not fit for the eligibility under physical handicapped category. Counsel has contended that principles of natural justice were not followed.

Learned counsel for the respondents has submitted that to evaluate benchmark disability, no due evaluation was carried out by the competent authority and no opportunity of hearing was given.

What is emphasized by this Court is that at one place under the Rights of Persons with Disabilities Act, 2016, there is a certificate issued by competent authority under the act, however, there is a dissatisfaction/ allegations of fraud on part of respondents. To evaluate the same, a medical board was constituted and evaluation was carried out to measure the benchmark disability in which it was found that petitioner was not fit for consideration and a fraud has been played.

Counsel for the petitioner at this stage has submitted that no such report was ever furnished to him along with documents. In the facts and circumstances, keeping the writ petition pending with this Court, this Court directs the respondents to constitute a medical board at AIIMS, Jodhpur.

Learned counsel for the respondents has submitted that AIIMS, Jodhpour will constitute the necessary medical board to evaluate the benchmark disability/ required disability.

The said medical report shall be duly furnished to the petitioner after carrying out the due evaluation. The same can be placed before this Court for perusal, and only thereafter, final order will be passed.

List the matter on 17.04.2026.

In the meantime, status quo, as on date be maintained and no recovery shall be initiated against the petitioner.

In the meantime, the requisite medical board be constituted at AIIMS, Jodhpur. The information be furnished to the petitioner by the respondents at the given date. A copy of report and relied upon documents be also submitted thereafter and a copy be also placed on record before this court.

Petitioner is directed to co-operate with the respondents, otherwise, an adverse view will be taken by the Court.
