Order

09/03/2026 By way of filing the instant writ petition under Article 226 of the Constitution of India, the petitioners have prayed for the following reliefs:-

“It is, therefore, most humbly and respectfully prayed that the present writ petition so preferred by the petitioner, may kindly be accepted &allowed and:-

1. By an appropriate writ, order, or direction, the decision taken by the gram panchayat (Annex.1) for converting the land into abadi area for allotmentpurpose without approval by the town planner as per statutory provisions may kindly be declared ultra vires, null and void, ab initio without any force of law.

ii. By an appropriate writ, order or direction, the Respondent Gram PanchayatAnjana may kindly be directed to produce the entire original recordrelating to issuance of 210 Pattas, including the two illegal Pattas (Annexure-5), before this Hon'ble Court, including but not limited to thePatta Books, allotment registers, approval files, layout plans, auction proceedings, and any permissions obtained from competent authorities, for proper judicial scrutiny; and iii. By an appropriate writ, directions, the gram panchayat respondent no. 5 may kindly be refrain from implementing the impugned resolution for allotment of pattas in favor of any person.

iv. By an appropriate writ, directions, the certiorarified mandamus may kindly be issued against the respondent no.

v. The costs of this writ petition may also be awarded in favor of the Petitioner; and. .....”

After arguing the matter for sometime, the learned counsel for the petitioner submitted that the petitioner would be satisfied if the competent authority of the respondent department is directed to consider and decide the representation of the petitioner against the illegal decision of the Gram Panchayat regarding the issuance of abadi pattas in favour of certain individuals.

In view of the aforesaid submission made at Bar by the learned counsel for the petitioner, the present writ petition is disposed of with a liberty to the petitioner to file a fresh representation along with a certified copy of the instant order within a period of ten days’ from today in the office of respondent department.

4. In case, a representation is so filed, the competent respondent department shall consider and decide the same in accordance with law as expeditiously as possible within a period of eight weeks’ from the receipt thereof.

5. It is made clear that the aforesaid direction to decide the representation in accordance with law has been issued only with a view to expedite the redressal of the petitioner’s grievances and the same may not be construde to an order to decide the representation in a particular manner.

6. All pending applications, if any, also stand disposed of.
