1. The present writ petition has been filed by the petitioner for quashing and setting aside the impugned judgment and order Jaipur (for short, 'the Tribunal') in Appeal No. 18/2023 tilted Shyam Singh Shekhawat V/s Sushil Khandelwal & Ors. whereby the Tribunal dismissed the appeal filed by the respondent No. 1.
2. Learned counsel for the petitioner submits that petitioner is the original allottee of the subject land but his allotment was assailed by the other side, hence, the main matter reached before the Arbitrator, who passed an order in favour of the petitioner and the allottment made in favour of the petitioner was found to be valid vide award dated 30.01.2023. Counsel submits that the aforesaid award passed by the Arbitrator was assailed by the respondents before the Cooperative Tribunal, who quashed and set-aside the award passed by the Tribunal vide impugned order dated 22.09.2023, against which the present writ petition has been preferred before this Court. Counsel submits that during the pendency of the present writ petition, now the parties have amicably settled their dispute by entering into a compromise and it has been agreed between the parties that the respondents would not claim any right, title and interest over the subject land and they have no objection if the impugned order dated 22.09.2023 passed by the Cooperative Tribunal be quashed and set-aside.
3. Considering the aforesaid arguments and looking to the fact that parties have amicably settled their dispute by entering into a compromise/settlement, the present writ petition stand allowed in terms and conditions of the compromise and accordingly, the Tribunal stands quashed and set-aside.
4. The compromise is ordered to be taken on record.
5. However, the rights of any third party who is not a party to this writ petition and compromise, shall not be affected by this order and compromise in any manner.
6. Pending application/s, if any, also stand/s disposed.
