1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No.11/2026 registered at Police Station Rathanjana, District Pratapgarh for the offence(s) under Sections 8/15 & 8/29 of NDPS Act.

2. Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated for the offence punishable under Section 8/29 of the NDPS Act. It is contended that recovery of contraband article was made from the other vehicle No. RJ-39-CA-6734. It is alleged against the petitioner that petitioner in connivance with the co-accused, who were found in the swift car, were escorting and transporting poppy straw which was found in the vehicle No. RJ-39-CA-6734. It is contended that in the said vehicle, the recovery was effected and one Vikram Singh was found in the vehicle. There is no connectivity of the petitioner with the co-accused Vikram Singh and further there is no substantive evidence available on record confirming the fact that the petitioner was escorting the other vehicle. There is no criminal antecedents with regard to the NDPS Act against the petitioner. The accused-petitioner is behind the bars since long and further trial of the case may take considerable time, therefore, the bail application may be allowed.

Learned Public Prosecutor has vehemently opposed the bail application and contended that petitioner's vehicle was intervened at the place of recovery with the other vehicle in which the contraband article was found. It is alleged against the petitioner that he was escorting the other vehicle and in connivance with the other co-accused Vikram Singh transporting the commercial quantity of contraband, therefore, the bail application filed by the petitioner deserves dismissal.

4. Heard and perused the material available on record.

Considering the arguments advanced by learned counsel for the petitioner and more particularly the fact that the recovery of contraband article was effected from the other vehicle and apart from the disclosure statement of the other co-accused, there are no other convincing facts with regard to the petitioner's involvement, therefore, without expressing anything on the merits of the case, I deem it just and proper to enlarge the accused-

petitioner on bail.

Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Tejpal Singh S/o Shri Hari Singh, in connection with FIR No.11/2026 registered at Police Station Rathanjana, District Pratapgarh shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so. The learned trial Judge shall also verify the address and the contact details of the surety through concerned SHO before releasing the accused-petitioner on bail.

7. The accused-petitioner is also directed to mark his presence on 25^th of every month till conclusion of trial before the concerned police station. The SHO of the concerned police station is directed to maintain a regular register marking the presence of the accused-petitioner and shall send the presence report of the accused-petitioner on the same day to the concerned Trial Court without any delay.
