----Petitioners Versus Rajasthan Public Service Commission, Through Its Secretary, Ajmer.
----Respondent For Petitioner(s) : Mr. Ram Pratap Saini with Mr. Aamir khan For Respondent(s) : Mr. M.F. Baig for RPSC HON'BLE MR. JUSTICE ANAND SHARMA
Order
13/03/2026
1. This writ petition has been filed by the petitioners with following prayer:
" It is therefore, most respectfully prayed that this Hon'ble court may very graciously be pleased to accept and allow this writ petition and further be pleased to:
i) Issue an appropriate writ order or direction in the nature thereof thereby direct the respondents to extend/reschedule the date of the Assistant Engineer Main Examination presently scheduled on
22.03.2026 and 23.03.2026.
ii). Issue an appropriate writ order or direction in the nature thereof thereby Declare that the action of the Respondents in altering the number of posts and issuing a second result without granting reasonable time is arbitrary and illegal:
iii) Pass any other appropriate order which this Hon'ble Court may deem fit, just and proper in the facts and circumstances of the case in favour of the petitioner.
iv) Cost of the writ petition be also awarded in favour of the petitioner."
2. The grievance raised by the learned counsel for the petitioners is that pursuant to recruitment process initiated by respondent-RPSC for recruitment on the post of Assistant Engineer, preliminary examination was conducted on 28.09.2025, result whereof was declared on 27.11.2025. Thereafter, by way of issuing corrigendum dated 13.01.2026, number of vacancies earlier advertised were increased and accordingly, revised result was also issued by enlarging the zone of consideration on 30.01.2026. Pursuant to such results, the respondent-Commission has scheduled second phase examination from 22.03.2026 to
23.03. 2026.
3. Learned counsel for the petitioners submits that thus, under the circumstances where result of preliminary examination has been declared in two phases by the respondent-Commission, the candidates who succeeded in preliminary examination pursuant to result dated 30.01.2026 would get lesser number of days for preparing in the examination in comparison to the candidates who were declared qualified pursuant to appointment result dated 27.11.2025. The respondent-Commission, being examination recruiting agency is required to act in fair manner and equal opportunity is to be granted to all the candidates preparing for main examination. Therefore, the petitioners have prayed that the respondent-Commission be directed to defer the main examination scheduled on 22.03.2026 and 23.03.2026.
3. This Court finds that the writ petition filed by the petitioners is totally misconceived, baseless and unfounded. The argument raised for seeking deferment of main examination appears to be malicious and not bonafide. Even the revised result was declared by RPSC on 30.01.2026 and main examination, admittedly, is to be conducted on 22.03.2026 and 23.03.2026 i.e.
with a gap of more than 50 days.
4. Learned counsel for the petitioners has utterly failed to point out any provision for giving minimum time period for conducting the main examination after declaration of result of the preliminary examination. In the aforesaid circumstances, there is no scope of interference in the instant writ petition hence, the same is hereby, dismissed.
5. Pending application(s), if any, shall also stand disposed of.
